I have an employer from 2007 who has informed me that I may not get my W-2 until May. I know that this is illegal, but what exactly can I do about it? I have a friend who said that I can report them to the department of labor, but what good will that do for me if I never get the W-2? |

Hopefully, you have your last paystub.
Legally, employers must have these mailed out no later than January 31, 2008. Here is what will really happen
On Feb 1, 2008 you will be able to call the IRS and report them (not the department of labor). The IRS will say, hold on and wait 2 weeks.
On Feb 15, 2008 you will call again, and they will say, well the company must file the governments copies by February 29, 2008, so call back the first week of March.
Around March 7 you will call again, they will direct you as to what form you need to file your taxes and to file a formal complaint. The company will be fined for both failure to give you your W-2, but the larger fine will be failure to file the government copies in a timely manner.
Personally, I bet you just caught someone in a snippy mood and they are bs'ing you. They will be fined if they don't get the government their copies by the last day of February.
As Congress screwed around with the tax law this year, the IRS has already said they won't be issuing refunds until mid-February or later. Wait and see what happens with your W-2 before you waste time and energy freaking out.

To solve your problem, you could just use the information from your last paystub to file your return and then go back and amend your return later. That is if you want/need your refund right away. The difference that you would owe or get back would be small if any at all. Most preparers don't care to do it that way but it can happen. You could do it yourself. Problem solved |

If you can get your employer's EIN (Employer Identification Number) then after a time frame you can file a substitute W-2 and file your tax return that way. You will need this number and check stubs or something to figure out how much your income is. Usually you have to wait until February but I am not sure about this year. |

The employer is supposed to have that paper to you by the end of Jan. 2008, call them and request it now, not later, and if they refuse call the IRS and file a complaint.
If you saved all of your pay stubs, then you can file with the information provided on them with an explanation of circumstances to the IRS, with no penalty. |

If you don't get it by 2/15, call the IRS. They'll try to shake it out of them. If they don't, the IRS will guide you in filing without it. I hope you kept your last pay stub from them so you have a record of what you were paid and what was withheld. |

You must provide your name, address (including zip code), phone number, Social Security Number, dates of employment, your employer/payer's name, address (including zip code), and phone number. With your information, the IRS will contact the employer/payer for you and request the missing form. IRS will also send you a Form 4852 (PDF) (Substitute for Form W-2 or Form 1099-R).
If you do not receive the missing form in sufficient time to file your tax return timely, you may use the Form 4852. If you receive the missing or corrected Form W-2 or Form 1099 after you file your return and a correction is needed, use Form 1040X (PDF) (Amended U.S. Individual Income Tax Return). Refer to Topic 308 (Amended Returns) for additional information."
Note that, in your case, the word "employer" refers to your "past employer", not your current employer. |
