W-2 situation. Please help!?
I was supposed to get my W-2 in the mail, but it never came. I found that I could check it up online so I did, but now W2 eXpress changed the store information so my login and password don't work. I then asked my HR person about the W2 and she gave me a paper to go into W2 eXpress, but from what I found out the reason why I haven't gotten my W-2 is because since I veiwed it online it was never sent, Then I found out other people are having the same problem I'm having and can't log into W2 eXpress. I heard you can do your taxes with your last paystub, but my problem is I don't know the employers fed/state ID, Address, city, state, zip. Is there a way of getting this info if there is no W-2?? The employer was Kmart, part of Sears Holdings

According to the IRS:

If you do not receive the missing or corrected form W2 by February 15th from your employer/payer, you may call the IRS at 1-800-829-1040 for assistance. You must provide your name, address (including zip code), phone number, Social Security Number, dates of employment, your employer/payer's name, address (including zip code), and phone number. The IRS will contact the employer/payer for you and request the missing form. IRS will also send you a Form 4852 (PDF), Substitute for Form W-2 or Form 1099-R.

If you do not receive the missing form in sufficient time to file your tax return timely, you may use the Form 4852. If you receive the missing or corrected Form W-2 or Form 1099 after you file your return and a correction is needed, use Form 1040X (PDF), Amended U.S. Individual Income Tax Return. Refer to Topic 308, Amended Returns, for additional information.

Talk to your HR department again, and ask them to either get you a copy of it or show you how to log in - let them know the password and id you had isn't working.

Consider using IRS Form 4852 in lieu of the W2.

As for address, ID numbers, etc, all you need to do is call another employee who has their W2 and ask them

Well, first your viewing your W2 on line does not exempt the company from sending you a hard copy of the W2. So they are in violation and can be fined for every occurrence (you stated others had the same problem).

If memory serves...since it is March now the fine is $100 for each W2 not mailed. This still doesn't help you though.

Your options are to go the payroll department and talk to the manager. They should be able to provide you with a copy of your W2 within a day (it doesn't matter if it is a faxed copy). If they claim they can't do that..they can surely provide you with the EFIN and state ID # that you need for a substitute W2 (to file with your last paycheck stub).

If they don't want to do that...you can always use the possible huge fines they will recieve (depending on how many people have this problem)...if they don't solve the problem promptly. Threaten to turn them in.

And, if that doesn't work you can still file your return as a paper return. The IRS will sort it out...it will just take a bit longer. I would suggest that you include a photocopy of your last paystub.

On the substitute W2 there is a section where you have to explain what steps you took to get a W2...simply tell them what you told us and they will investigate and apply the proper fines.

This must be a problem with the system they are using. Try contacting the payroll department and see what you can do.

You can also estimate your W2 based on paychecks.
Third option is to report to the IRS

you can have it resent to you through the kmart corporate office, but it may take too long for the deadline, ask your company for they id numbers and and addresses and use your last paystub
