If your 2002 return shows a refund due, it's too late to file and receive the refund. The deadline for that was April 15, 2006.
If your 2002 return shows a balance due, I would suggest that you hold off until April 15th of this year before you move on it. The IRS has 6 years from the filing deadline to assess tax if a return was not filed. If you don't hear from them by April 15, 2009 they can no longer assess and collect the tax under the SOL. While there is no SOL on tax fraud or tax evasion, the courts have held that failing to file is neither tax fraud nor tax evasion but simple negligence. At best they can assess tax under the "significant misstatement" rules and the SOL on that is 6 years from the original filing deadline of the unfiled return. |

Before the IRS will grant a payment plan, it requires that all tax returns for the past 6 years be filed. 2002 would be fair game if it appeared the taxpayer would owe.
Since the IRS SFR program always assumes single, no kids, no deductions, no cost basis, the poster may discover that an actual return would limit the tax bill, penalties and interest from an earlier year even if the most is can do is get a $0 tax bill and not a refund.
(Refunds are only possible if he was in a coma, a combat zone or filing for, say, damage from Hurrican Katrina....)
For simple taxes (income below $40,000), the IRS walk in offices will help. |

Any professional tax preparer can prepare a tax return for you for 2002.
You could also go to ww.irs.gov and they have all the prior year forms and corresponding instruction and do the return with pencil and paper.
You can purchase copies of a tax preparation software program for the 2002 tax year and complete your return with it.
If the return shows a refund is due you, then you need do nothing as it is too late to obtain a refund of 2002 taxes withheld. If it shows a balance due, you will enclose a check for the amount due with your return and you will later get a bill from the IRS for the penalties and interest for not filing and paying on-time. Any return you file will need to be mailed to the appropriate IRS mailing address as it is too late to e-file.
Note, you may also need to file a return for the state in which you lived if you have a balance due to the state.

You must file paper return. Download 2002 tax forms from www.irs.gov and fill it. If you have a refund, you will not get it. If you owe taxes, you must pay with interest and penalty.
