Was the 16th amendment ever ratified? I don't think so.... There should be no law to pay INCOME taxes.?
It's a direct tax, not apportioned.

Interestingly, I've been immediately jumped on and tagged a "tax protester".

Perhaps I just follow the constitution.

Here are links on the fact it isn't ratified:
http://www.givemeliberty.org/features/taxes/notratified.htm

http://www.thelawthatneverwas.com/new/home.asp

http://political-resources.com/taxes/16thamendment/default.htm

It's amazing how many people resolve to threats when it comes to taxes.

The trouble is since the 16th was not ratified that means that the INCOME tax is illegal.

(I am not speaking of property and gas taxes etc.)

How is it that some of you argue against fact. These are facts presented. Courts can say what they like but the facts remain.

In my opinion it is my duty as a person of the United States to not pay this illegal tax.

I may get bars. But YOU will have to pay for it from your the taxes that you are having to Illegally pay.

And let's not even get into self-incrimination and signing your 1040. (yet)

Exactly how many times are you going to ask the same question?

The 16th amendment was ratified by the required number of states by Feb. 3, 1913.

http://www.gpoaccess.gov/constitution/html/conamt.html

That amendment gave Congress the specific power to lay and collect taxes on income without apportionment.

The LAW that say you must pay taxes on income is in Title 26 of the U.S. Code. If you don't think the U.S. Code is law, then you don't believe in the benefits given to citizens by the U.S. Code either. The specific section of Title 26 that requires an individual to pay income taxes is TITLE 26, Subtitle A, CHAPTER 1, Subchapter A, PART I, Section 1.

http://www.law.cornell.edu/uscode/html/uscode26/usc_sec_26_00000001----000-.html

So, since I gave you the correct answer, are you going to ask this question again?

Edit: After revisiting this question again, I decided to read the links you provided in your question. It took me all of five minutes to find an error in one of Bill Benson's arguments. The Tennessee Constitution does not require the Tennessee State Legislature to wait until after the next election of legislators to vote on amendments to the U.S. Constitution. The Tennesse Constitution requires the wait on election of legislators to vote on amendments to the TENNESSEE Constitution. Nowhere in the 1909 version of the Tennessee Constitution does it require this wait for amendments to the U.S. Constitution.

Here is a link to a website that debunks Bill Benson's "research".

http://www.quatloos.com/bill_benson_debunked.htm

Go ahead and not pay income tax, you can spend time in jail for tax evasion, just like others who believed Bill Benson.

You reference the Constitution, but you do not follow it. The Constitution very clearly states that the Supreme Court has final say in its interpretation, and the Supremes have ruled on this one. Now what, smartypants?

Go ahead and not pay it. I dare you.

United States v. Bressler, 772 F.2d 287, 291 (7 th Cir. 1985) - The court upheld Bressler's conviction for tax evasion, noting, "[he] has refused to file income tax returns and pay the amounts due not because he misunderstands the law, but because he disagrees with it . . . . [O]ne who refuses to file income tax returns and pay the tax owing is subject to prosecution, even though the tax protester believes the laws requiring the filing of income tax returns and the payment of income tax are unconstitutional."

Schiff v. United States, 919 F.2d 830, 833 (2d Cir. 1990), cert. denied, 501 U.S. 1238 (1991) - The court rejected Schiff's arguments as meritless and upheld imposition of the civil fraud penalty, stating "[t]he frivolous nature of this appeal is perhaps best illustrated by our conclusion that Schiff is precisely the sort of taxpayer upon whom a fraud penalty for failure to pay income taxes should be imposed."

Packard v. United States, 7 F. Supp. 2d 143, 145 (D. Conn. 1998) - The court dismissed Packard's refund suit for recovery of penalties for failure to pay income tax and failure to pay estimated taxes where the taxpayer contested the obligation to pay taxes on religious grounds, noting that "the ability of the Government to function could be impaired if persons could refuse to pay taxes because they disagreed with the Government's use of tax revenues."

United States v. Gerads, 999 F.2d 1255, 1256 (8 th Cir. 1993) - The court stated that "[taxpayers'] claim that payment of federal income tax is voluntary clearly lacks substance" and imposed sanctions in the amount of $1,500 "for bringing this frivolous appeal based on discredited, tax-protestor arguments."

I give up.

If you follow this path, you will be in for a life of misery.

Show me one example of someone who got out of paying his or her Federal income taxes by using your theories above. None of what you have posted is new. Crackpot theories about the income tax have been around since 1913 and no court has ever sided with tax protesters.

Kris
It was raitified but with faults, however the legal branch upheld it therefore making it a part of the constitution

As long as 2 branches of government agree it is legal it becomes so -- fair no -- 2nd cite talks about a lawsuit filed with q & a explaining this

do i agree NOOOOOOOOOOOO

STEVEN F
Interestingly, I've been immediately jumped on and tagged a "tax protester".

Even if EVERYTHING you claim was true, you ARE a tax protester.

Please name ONE state legislature that is willing to state ON THE RECORD that they did not ratify the 16th amendment. Unless at least 25% of the states that existed at the time will make that claim, you have no case.

Have fun in jail. You'll need a new name though, like "Susan"...

"Facts" are less than worthless when it comes to "the law". There is NO perfect system, but the rest of us already have decided to live by the basic precepts of the current legal system because all things considered it's pretty good.

Under the laws as interpreted by the Court, the other 299, 999,999 of us have agreed to pay income taxes to fund the US Government. If you have a Constitutional problem with that, you have the right to say so, but that won't keep you out of jail!

IRS fraud
I know but what are you going to do about it? email me at whyistheworldsocold@yahoo.com Or what have you done about it? I have seen america freedom to fascism. but what did i do?

Its easy to cry about the taxation, but I bet your quick to drive on the roads, use the infrastructure, enjoy the safety provided by the fire dept, police, and military, use the schools, and use the healthcare system that are supported by Federal, State, and Local Tax Revenues!!!

vinlunney
unfortunately 36 states DID ratify it on Feb 3, 1913. I'm proud to say that my home state of Rhode Island was one of the few to reject it.
