We were eligable to claim our grandson who lives with us on our taxes as a qualifying relative, but his father
but his father who did not support him and the baby did not live with him, claimed him on his taxes, the father is 18 and lives with his parents. The baby was born in Sept. our daughter turned 19 in Oct. We paid all expences, cost of insurance, co-pays and deductibles, clothes, crib, furniture, supplies, took her to all appointments etc. the father did not pay one penny for anything. We did not claim the baby on our taxes, but filed a tax fraud claim and asked the IRS to notify us when they resolve this so that we can file an ammended claim. Will the IRS investigate this and get back to us. or should we file an ammended claim now. we already got our refund but we lost $850 by not claiming him and will loose 300 in the incentive rebate.

I'd amend it now. Why didn't you just claim the grandson the first time? Who the father claims is between him and the IRS, you shouldn't have let him get in the way of your rightful deduction.

you can claim him and if the irs checks into it he will be the one in trouble because the child has to live with the person and since he doesnt live with his father, the father will be in trouble.

Pull together all your receipts that show you provided support - and that the child lived with you at least 6 months of the year - and go to IRS for assistance in filing amended return. You should be okay that way.

You may also be able to claim daughter as dependent if she lived with you and you provided shelter, etc. that is more than half what she pays for.

If the father didn't live with the baby, he can't claim him. I assume your daughter lives with you and with the baby -she could claim him, or you could, but not the dad. If your daughter claims the baby, you can't, but if she doesn't, you should amend your return now and claim the baby. That will also be sure to get the IRS looking at the deadbeat dad.

The IRS will investigate it but, it will take some time, file the claim now your going to have to do it anyways.

Next time, file your taxes correctly the first time on paper. A paper return would have added 2 weeks of processing time and the IRS would have already starting resolving the duplicate SSN issue. And when the rebates are issued, you would have gotten the $300.

You will not get a letter from the IRS saying, hey, he fixed his, now file. YOU NEED TO FILE THE 1040X NOW. You could do it at any time. For rebate purposes, if you claim the child in 2008, you might get the $300 THEN.

I'm guessing the preparer was getting paid out of the refund and told you they had to take the child off in order for you to file electronically (true)--had you taken cash and actually paid for your return, they would have printed it and let you mail it in. And guess what, the 1040X is a PITA to do; you'll get charged if someone prepares it for you. (Go to the nearest IRS office if your income is less than $39K. They'll do it for free)

I would file the amended claim now.. you are the child's sole support.. and if the child is living within your home then you can take a grandchild off the income tax. You have the proofs and receipts.
You didn't mention if you daughter married him.. that is part of the equation too.

The first thing that comes to my mind is: How in the world did the father gets the son's social security number? If he didn't have it, he can't claim him.

Oh trust me they will investigate...and will garnish his wages in the future if he has any. It may take time but it will all pan out im sure. Good Luck
