We were legally separated at the time and per the divorce decree agreed to file our taxes jointly for 2003. Needless to say, the taxes didn't get done and sent in until Fall 2006. He informed me that we weren't getting anything back because we filed too late. I contacted the IRS and they stated that a check had been mailed out in August 2006. I think he signed my name on the back of the check and kept all of the refund. What actions can I take if this is the case? The IRS is stating that since we filed jointly I would have to take legal action...okay the divorce cost me quite enough...! Would he be charged with forgery? And we're talking about a federal tax return...how bad could that be for him? (He's always saying he has no money, but gee, he just bought a Harley motorcycle last Fall....hmmmmmmm) I just found out about this today. I will be contacting my local County Prosecutor tomorrow to see if they can steer me in the right direction. Any ideas? |

Get all the information down in writing from all offices then take him to small claims court!! Just make sure you have all the evidence.

Forging someone's signature on a federal tax refund check is a very, very serious crime. He could be looking at doing time in a federal penitentiary, which is no joke.
Quite stupid of him! The Feds don't play games when they go after someone who's forged a signature on one of their checks. |

Your best bet is to contact the police. Forgery is a serious crime and should be reported. The police can then subpoena the bank for a copy of that check that was forged. From there, they can press charges. Small claims court should be a last resort. Usually, after the criminal charges are brought to the court, you can then file civil charges to get your money back. |

I agree with the call the cops group, but you could tell your ex that if he gives you your 1/2 (make sure you have proof of the amount, as someone else pointed out by getting a copy of the check), then you won't call the cops. Since you would only be getting money due you , I don't think that qualifies as blackmail. |

Truthfully, the jurisdiction of the crime is what will determine the initial course of action. My suggestion would be to call the FBI first and ask them what course of action that you should take. Since the check was a federal tax return, then I believe that it would fall out of your county prosecutor's hands...
The below link will take you to the FBI website where you can locate your local office's toll-free number. They are extremely helpful in regards to any questions sent their way... and hire the best and the brightest within their ranks. If it falls within their jurisdiction, your husband will have two agents knocking on his door very soon...
Also, ask them about how you should go about getting your money back from your husband. You may have to wait until he is charged, or found guilty, before you can file a civil suit to reclaim the money. Your attorney will probably tell you to include damages within your suit, so you may actually get more than just your refund. |

If it was payable to you and he signed it over as a double endorsed check and put it in his bank account then you do have recourse as you could declare the check stolen. The fact that bank even accepted the check which was presumably payable to you could make them liable also. |

Yep, forgery, fraud and contempt of court.
Try to get a check number and a copy of the endorsements from the IRS and go to the cops and file charges.
Wait and see what happens with that and then sue his butt in small claims court. Once you have proof from the IRS you can sue him!
