My friend received a letter for the IRS where he needed to contact their office. He has not filed in 4 years. What will happend to him if he contacts? If he does not contact them what will happen to him? |

If he doesn't contact them, they will eventually find him anyway.
He will owe back taxes for the past 4 years, plus late fees, penalties and interest.
If he cooperates the IRS can help him work out a payment plan to pay back the taxes or he can pay it back at once.
By contacting the IRS he may have a better chance of working something out to pay back what he owes, and they will be less patient if they have to track him down.
They also can sell the tax debt to a collection agency and eventually it can go to court. His wages could be garnished, bank accounts and assets confiscated etc.
He may also be at risk for jail time for tax evasion, especially if he continues to not pay and tries to avoid the IRS.
If the IRS knows he owes them money, they will get it one way or another. |

If he has received a letter, then he must contact them. If he misses the date, it mean that he agrees to all what IRS claims. They will then send him a bill for the tax due based on their own judgement, which will be much more than what he actually owes the IRS. He will spend rest of his life paying the tax due.
What does the letter say? May be he should contact a local tax professional who has experience in dealing with such case.

If he contacts them, they will ask him to file his returns. The talk about jail is ridiculous. At this point, the returns are what they are after. Once the returns are filed, they will begin asking for money, if any is due. For a self-employed person this is likely because, if he had net income, he will have self-employment tax - this is the self-employed person's equivalent of social security and Medicare - but the self-employed person pays both the employee's and the employer's share - so it is about 15% of the net income from self employment. It is possible that there will not be any tax liability - I have worked with self-employed non-filers who ended up with enough business expenses so that there was no or very little net income.
In this sort of situation, because of the leverage involved in the net income from self employment, I would suggest contacting a “Circular 230” practitioner (Enrolled Agent, CPA, or Attorney) who is experienced in both self employed business taxes and taxpayer representation. Circular 230 practitioners may represent the taxpayer before the IRS and will be able to help prepare the returns, deal with the IRS staff, and protect your friend’s rights. The representative will also take measures to assure that your friend gets into compliance and stays there in a much more friendly way than the IRS will.
Enrolled Agents are uniquely qualified to do this as they have either passed an exam given by the IRS or have worked for the IRS as auditors for 5 years or in another capacity for 10 years where they regularly applied the tax code and regulations. They are licensed by the IRS to represent taxpayers but work for the taxpayer.
On the other hand, if your friend was overtly committing tax fraud or doing similar stuff to what Wesley Snipes got himself involved in, jail time is a possibility. It does not sound as if it is to that point in the situation you described.
The seven year thing that someone mentioned is not true. There is no statute of limitations on a return that has not been filed or tax that has not been assessed. Once tax is assessed, the IRS has 10 years to collect it. There is also no statute of limitations on fraud. Fraud is essentially lying to the government. |

They'll want to review his records, and he'll be assessed back taxes plus penalties and interest.
If he ignores it, he'll get another letter from them, eventually certified, and if he continues to ignore it someone will show up on his doorstep. It's NOT a good idea to ignore summons from the IRS - it doesn't go away, and it's just that much worse when they finally DO get to you. |

your friend should make an effort to file...they may help. If they help it will cost more than having an accountant do the paperwork. it is likely that a payment arrangement will be worked out. |

Tell him to get someone who specializes in tax law.
They will put his taxes together and either he will pay them with the penalties OR he will hire the tax lawyer to take it to the next step and ask him to try and negotiate a settlement with the IRS.
Do it now, do not wait too long as if they have to come to you it will cost you a LOT more! |

they will audit him and do the taxes for him, you need to get hi to get together with someone at H&r block and then when he files he can either get a loan and pay like I did or make payments but they charge a lot of interest I got a better loan and got it payed off quickly. He should be taking 25% out his check and sending them anyhow for estimated taxes he's got penalties and all that you can bet he owes a lot now! They will do his taxes for him if he dont and he can get liens filed against him it'll ruin his credit it's not good. |

Have your friend contact an EA or CPA. He should sign a form 2848 and have the tax pro represent him at the meeting. Prepare the returns and have them ready to give the IRS agent preferably with full payment. Don't go to HRB, JH or the other storefront places. You need a pro. |

If you contact them they will have you pay all your taxes plus whatever the four years of interest will be. You will want a lawyer that specializes in the tax area to help you out when you decide to contact them.
If you don't contact them you SHOULD start filing taxes and hope they don't contact you in the next seven years (after seven years you cannot be charged with tax fraud). If they do contact you you will probably be hit with a hefty fine or the possibility of jail time (but probably a low security prison, not the "don't drop the soap" prison). |
