What do I do if my employer won't give me a W2 form and wants to pay me cash instead?
I am 18 years old. I worked for a company 9 months last year. All of my checks were hand written with no check stub. My employer held out taxes but I never knew how much since he never gave me that info. He pocketed the money he held out and now he can't give me a W2 form and he is trying to pay me cash which isn't the right amount anyway. I don't know what to do. I am upset and I can't file my taxes now. He's being a jerk and trying to give me $200 to make me go away. What should I do?

Oh my gosh, he can get in trouble. If it were me, I would look up online the taxes (irs.gov, Publication 15 is what you are looking for, tax tables, plus 7.65% for social security) State tax also if your state has tax and I would ask for that amount in cash. I know it is not right, but you wont get a refund anyway because of him not filing the taxes, so take the cash. If you need help with figuring out how much you paid in taxes, email me.

you should report him to the IRS...immediately.

Can you talk to your parents about this?

What he's doing is *illegal*. It needs to be reported to the authorities.

Wow! You need to contact the IRS and explain the situation immediately. He sounds like a real crook and you shouldn't be the one to pay for it.

Go to the dept of labor in your state. he needs to give you a W-2 (co emp)or a 1099 (self emp). he is breaking the law. he is not payins fed tax, ss tax and state tax.

call the IRS and the state labor board on him - he hired you as an employee and didn't pay you properly, he also probably did not pay any unemployment taxes on your behalf either, which means you won't be able to file for unemployment benefits until you work at least 5 more full calendar quarters for a company that actually pays into the unemployment system - if he didn't pay taxes - he has to pay you the full hourly wage he hired you at if he hired you at $9.00/hr and he's only been giving you like $280 for a 40 hr week, then he owes you $2.00 for every hour you worked last year- before any taxes were taken away - figure out how much he owes you if he withheld taxes and then tell him to pay you that much or you'll report him to the authorities and then report him, no matter what he does - but wait and see if he gives you money - if he doesn't give you anything to file, then don't file, because you'll have to pay all the taxes he didn't pay - social security as well as federal and state income taxes - sue him, rat him out and find a different job

Call the IRS and report him. He's doing a variety of illegal things, and some of them will affect you.

JG
Where you salaried or paid by the hour? Calculate how much you should be making and tell you "employer" to give you all your money without withholding money for taxes or you will report him to the IRS or the local county/state tax collectors. He might just call you bluff and fire you so I hope you are looking for another job.

gr8ful_one
request a 1099... by law he must give you one or you must report him to the IRS and better business bureau and look for a better job because this one is only going to get you more in trouble and he is a criminal...and a cheat

Besides you are not elligable for bush's "fun money" until to file...600 bucks

Call your state's labor relations board, or write to them. You can also file a complaint with your state's revenue cabinet.

Don't let this guy get away with cheating you and the government out of money. Talk to your parents and take some action!

Tell him you are going to call the IRS. He will be in big trouble.

so confused
My boyfriend was working for a trailer park fixing trailers, plumbing ,water leaks ,roofs ,you name it it was doing it. He was working there for about a year, and his boss started paying every 2weeks with a payroll check. But the only thing on it was my boyfriends name the name of the company he worked for ,the amount he made and the start and end of the pay period. Nothing else there were no taxes , or any kind of health or medical taken out. Then he started paying all the employee's by a personal checking account. And after my boyfriend quit, he called him about 6 months later to ask him for my boyfriends SS#. but didn't say why. so can my boyfriend still file his taxes without having a 1099 or a W2 Form , if so how does he go about filing his taxes this year?
