He doesn't need a lawyer, although seeing a CPA might not be a bad idea unless he's pretty comfortable with filing his own taxes.
He needs to gather up all his paperwork and get the returns filed.
If his income was all W-2, the good news is the most likely situation is that he doesn't owe anything, and probably has refunds coming, if he hasn't heard from the IRS by now. The bad news is that it's too late to collect any refund he should have had for 2004. He can still get them for 2005-2007 though. |

Yeah, you will probably want to get a tax accountant and a lawyer. He will be liable for the back-taxes as well as penalties and interest on the amounts owed. If he overpaid during those years it will not be a big deal - if it was just his return he didn't file. If he actually didn't pay the taxes then he could even face jail time. |

The sooner he files the better...he's going to owe not only the back taxes themselves but TONS of interest and late fees. I wouldn't worry TOO much about jail time, he's not making enough to make the IRS take notice, but if he waits too much longer they just might. He should be able to work out a payment plan with them. Unfortunately, it may be for a lot more than he would like to pay monthly. |

Contact the IRS, pay as much as possible in the letter. File the late returns now. Ask that they waive the penalties and stop accruing new interest, since he came forward (they probably will not waive interest). Ask for a payment plan in your letter, and then stick to the payments.
Show real remorse and if possible mention any hardships (temporary insanity, temporary blindness, short term coma - what ever, but don't lie).
You will have to take a bitter pill for this one, but it is better that than them knocking on your door, seizing all your assets (furniture, jewelry, cars, etc.)

Have him call the IRS as soon as possible. If he needs to setup a payment plan, he will need to be compliant with filing. However, it's possible that he will not have to file all the delinquent returns. The representative will determine which ones he has to file and give him time to do so.
As far as penalties and interest is concerned, he will owe them on any delinquent returns that he files that have balances due. Although he could ask for an abatement, there has to be a reasonable cause for the failure to file and pay on time. |
