Child wars. Kidnapping. Sounds like tax time.
There are rules about who can claim a child.
Get your records together. The IRS will be interested in who the child lived with most of the year. School records, medical records, lease (if you rent) agreements, etc., showing that (s)he lived with you, and not with him.
Then file a tax return, using the child as a dependent. The IRS will ask you and him for above records. Be sure that the kid lived with you most of the year, and that you provided most of his or her support.
If he already claimed the kid, you might need to do a mail-in paper return (not efile--efile matches social security numbers that have already been used.)
If the IRS believes that he filed with your kid as fraud, rather than a simple mistake, then he can be barred from EIC. |

You file your return also claiming the child. The IRS will require both claimants to justify their returns. |

If you also filed a tax return and claimed the child, you already did report him, and the IRS will investigate.
Otherwise, call the IRS.
If you tried to efile and your return was rejected because the child had already been claimed, then file your return by paper, and see the first line of my answer. |

File a paper return and claim your child. You can't e-file if he already filed, but you can file a paper return. The IRS will investigate the issue and award the exemption according to the law. Assuming that you win, you'll get your refund, EIC, Child Tax Credit, etc. and he'll get a bill for the tax that he owes due to the loss of the exemption, plus penalties and interest for late payment going back to April 15th.
There is NO other way to report this. Just file your paper return and let the IRS do their thing. If you already filed without claiming your child, you must file an amended return using Form 1040-X |

You can mail in your return to the IRS claiming your child. Only one person can claim a child so the IRS will then investigate. |

A general rule, stated coldly in "who gets to claim the child" cases is that the parent who has possession of the body gets the write off. |

If you both claim the child on your returns, you will both be contacted by the IRS. The loser will end up paying penalties and interest. |
