What do you do if your employer won't give you your w-2?

davidg32
By law, he has till the end of January. If you don't have it by then, ask him about it...and if he still won't give it to you, call the local IRS office and tell them. THEY'LL see that he sends 'em out.

Rob
If by Jan 31st you have not received your W2, call the employer and ask them if they have been sent. If by Feb 15th you have not received it, call the Internal Revenue Service and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them
Call 1-800-829-1040

Mindy
Call a lawyer since they are required by law to have them postmarked to you by January 31.

cmsmith114
They HAVE too give you a W-2. They by law have to have them all mailed to everyone on Jan.31. Most places wait until the last minute to get them out.

If you have an old paystub, that should be all the information that you need. But I would report the employer to the IRS, too.

They have to give you a W-2 by midnight Jan., 31 if they don't then call the IRS. They can be fined for not giving you a W-2 by the 31rst. This is the law under tax laws.

BookWorm
Your employer should definitely have given you your W-2. I think they should have it to you by Jan. 31st. I would go to the IRS website, and they have a phone number you can call, and they can send you another W-2 or an alternate form.

They technically have until the end of January to hand it over... Give them a couple more days

J.R.
There is a form, can't remember the number, that you file with your estimated amounts. You can get these from your last paystub of the year. You can call the IRS for the form, or it may be worth $40 to get H&R Block or someone to do your taxes for you. Just don't fall for the refund anticipation loan; it is a huge ripoff.

Simplekindoflife
Use your final pay stub. If you go to a tax preparer, or file your taxes on line (say with Turbotax) there is a section on your tax forms to notify the IRS that you were not given a w-2 and that you have to use your paystub. *since the option to report this is on the tax forms - it would appear that it is a common occurance - so don't panic too much about it.

Report them

momof9
They aren't legally required to give it to you until January 31st. If you don't have it by then, report them.

The employer has until 1/31/07 to get your W-2 in the mail to you. If they are just not cooperating, you can get the info you need to file off of your last paystub. You can also report them to the IRS and they will be fine for each W-2 that was not reported timely.
