He's deep in debt and I really don't think he will be issuing any w-2's to any of his other employers either. I believe he is already in trouble with the IRS. I want my forms so that I can file.What do I do next???? |

I had this problem once. I called the local IRS office and they got all over the employer about it. I wound up getting my W-2 by the end of February. I'm not sure how the IRS handles it if you don't get your W-2, however there's now an independent organization within the IRS called the Taxpayer Advocate Service which is designed to help you with problems. They're at the link below. |

Employers have until January 31st to provide you with your W2s by law so you cannot do anything until then. At that point, you can ask the IRS how to proceed. Your 2006 year end paystub will give you the amount of income and taxes withheld if that's your only option to file. |

If he won't give it to you, you should contact the IRS. You're trying to be responsible for your taxes, don't let his mess drag you down. |

contact the irs asap. the longer u take to do it--the longer it will take to get them. (keep in mind though, that by law, i think he has until the last day of january to mail them) (You might check to be sure on that--ask the irs when you contact them) |

If he does not mail the W-2 or hand it to you by january 31st you have to take reasonable steps to obtain it from him. what those steps are really depends on the situation, but you should document all action you take. If you do not have it by February 15th you can do a Substitute W-2 from your paystubs (Form 4852). |

Report him to your state tax agency and the IRS. They will help you figure this out. Hold on to you last pay stub of 2006, hopefully it has YTD withholding. BTW, does he or an external company do the payroll? If it is external, contact them. |
