You should file married filing separatly until she clears up her obligations. You don't want the money she owes being deducted from your refund.

DON"T even think about HOH. You're married and together and have choice of MFJ or MFS. MFS is almost always less favorable, and means NO Child Tax Credit, no EIC, etc.
You can file innocent/injured spouse to protect against back taxes by new wife. Then only her share of refund can be grabbed. The stepkids are now legitimate exemptions for you, and can be "yours" even if you get divorced, by IRS rules.
FYI: Jade is wrong, breaking the law if she is married, together and filing Single.
Suggest you and your wife pay off her back obligations so you don't have this cloud hanging over you. You may have a larger than usual refund coming this year--think about paying off what she owes!

You can' t do head of household now that you are married and living with your wife.

I would figure it both ways - married jointly and separately. If separately is better or nearly the same as joint, just file separately. If joint is a lot better which is usually the case, file jointly with an Injured Spouse form included. That form with divide up your refund into yours and hers, so you will get yours and she will have her part held for the back offsets. Make sure you allocate the kids to you to help your part of the refund. That is legal because the IRS sees the kids yours as much as hers ever since you said "I do".

In order to qualify for any credits such as the earned income credit,you will need to file jointly. You can file an injured spouse form along with your tax return. this will allow the IRS to refund you the amount that is due to your income and deductions.

If you go married, filing seperate, you forfeit your EIC & CTC and education credits and yada. Better to go as married, filing joint, and simply fill out and include with your return a Form 8379 aka INJURED SPOUSE ALLOCATION wherewith your refund cannot be touched for an obligation of the spouse. No problemo.

You can't file as head of household. You can either file as married filing separately, or file a joint return and file an injured spouse form with your return.

You can not file as head of household.
You can file only as married filing jointly or married filing separately. If you file joint return, you can also file Form 8379 (Injured Spouse). The IRS will allocate the refund between you and your spouse.

If you file separately then you can't get credit for the kids when you say married jointly you get more credit for filing with spouse and kids.

i think the best answer i should give you is if you do your taxes through hr block they should be able to give you the right answer they can't do what you don't want to do just explain they will be able to tell you the Truth i know for sure that if your wife owes some money and you are married you are also included me in your case i would file file married filing separately so that way she will get her own discounted problem when she does her own
