an audit and will have to repay the amount and will not be able for EIC for a number of years only one person can claim your child on the return the irs will put a hold on both of the returns until it is sorted out may be months to get to the bottom of it

Whoever is the legal custodial parent, whichever parent the child lives with more than half the time and whichever parent provides more than half of support (not including court ordered child support) is entitled to claim the child. All three tests must be met. IRS will lean toward whoever filed first. However if dad can't meet the above tests (custody, residence and support) he has taken a deduction to which he is not entitled. IRS just hates it when someone does that. There is more to it that what I have put here. If mom is the custodial parent, etc., she can agree to let dad take the deduction by completing an IRS form 8332 for him to file with his return.

The person who files first will have it go through, while the other person will get a notice saying that the child was already claimed on another filing. The person who files second will have their tax return modified so the claim is no longer on there and the refund will reflect that change.

The IRS will be able to tell if the dependant is valid, which means that not just anyone can use your child on their tax return. But since your daughter will come up valid for either you or her father, this shouldn't be a problem.

So if you intend to claim her and have it go through, you will have to file your return before her father does.

But whoever is legally entitled to claim her should be the one to use her. If you are legally entitled to claim her, while he isn't, then he shouldn't use her and vice versa.

He and you will each receive a letter from the IRS telling you that two people claimed the same person, and saying that whoever didn't have the right to the claim needs to file an amended return dropping the claim - then if nobody does, they'll investigate and decide who gets the exemption. The other person will have to pay back whatever he got by making the claim he wasn't entitled to, with interest and possible penalties.

one of you will have to give up the return you got on your taxes. But if you can prove that you have been the sole provider for 6 months or more out of the year, you wont have to return ur tax money.

The IRS might look into it to see who the kid actually lives with. BUT who ever files 1st get the credit...the 2nd on line gets told "sorry this tax id was already used'

An tax audit is in order. Only one of you can claim your daughters or you can claim one daughter and he can claim the other. If you don't get caught this time, you are one lucky lady, so make a decision on who will claim whom before you file next year.
