What happens if I don't include an employer when I fill out my yearly tax returns?

The IRS will still know about the income. They receive copies from the employer of all W-2's they sent out. I would at least call the employer and ask for a copy. Don't leave it off your tax return - the IRS may audit you and that sucks. My husband never received a W-2 a few years back and subsequently did not report it. Well, the IRS found it! The kept our refund this year and we just had to pay them an additional $2 grand as result of additional tax, penalties and interest for the taxes he would have owed at the time. Suck it up and call your employer and ask for a copy. Your only other option is to file without it and then call the IRS after a few months and ask them if they can mail you a transcript for whatever year that will show you wages that were reported using your social security number.

Sometime in the next year or two, the IRS will catch that and send you a CP2000 letter, advising you that you failed to report some income and assessing the tax due, plus penalties and interest. That can add 25% or more to the total debt you owe. The odds of the IRS catching this are 100%; you WILL lose out in the end.

You don't get a choice on this, you MUST include all income. If the employer hasn't sent you your W-2 and they have your current address, call the IRS at 1-800-TAX-1040 and file a missing W-2 complaint. You should have your W-2 in a week or two. If the employer still fails to give you your W-2 after that, the IRS will assist you in generating alternate documentation of your income in lieu of the W-2.

Something to always remember about taxes is your employers report all your wages to the IRS.

If you file your return without that last W-2, and don't report the total income you made during the year, the IRS will catch it as it will not match what they already have in their system.

You will then receive a bill for any additional taxes that you owe on that money along with penalties and interest.

Regardless of bad feelings you have to make an attempt to get the W-2 from your old employer. If you make all reasonable attempts, and they still don't get your W-2 form to you, then you may call the IRS to file a complaint and use the Substitute W-2 form (form 4852) to file your taxes this year.

If you'd owe any additional tax due to that W-2, the IRS will send you a letter informing you that you left off that W-2 and demanding the additional tax, plus penalties and interest.

As others said, the IRS will catch that the W2 was not reported on your return. And if you owe more because of it, they will send you a bill. Plus penalties.

There is another scenario that the others did not mention. Like the other scenario, this one also costs you money. Actually, if could be big bucks. There is the possibility that throwing the other W2 into the mix increases your tax refund (or would reduce the amount you owe). And if that is the case, the IRS may NOT tell you about it. You will simply lose the additional money that should be coming your direction.

Get a copy of the W2 and do it right. If you can't get it in time, file an extension using Form 4868.

Unfortunately, you do have to claim the income from your former employer. They reported to the IRS what they paid you, so if you don't, you may get in trouble with the IRS. They tack on hefty fees and then you have to deal with paying the back amount in full or making a payment arrangement with them which will cos you another $40 just to set up. Go to www.irs.gov and report a missing W2. You don't have to see your former employer, but they could get in trouble for not sending you your W2. The IRS will assist you if they are being jerks about it. Good luck!!

Assuming your employer filed your W-2 with the Social Security Administration (SSA), as he is legally required to do, SSA will send that information to the IRS in June or July. Sometime in the next year to year and a half, an IRS computer will compare the wage and withholding information on your return with the same information on all your W-2s. If the difference is significant, the computer will generate a report so a human can check it out. You will eventually get a letter pointing out the difference and proposing a change to your tax assessment, plus interest and late payment penalty from 4/15/2008. If you agree, you sign the agreement and send it back, with payment if you can.

If you have your last paycheck stub, you can use that information and report a substitute W-2... But whatever you do, you need to find a way to report that income and withholding on your tax return...
