It's called "Tax Fraud".
A person receiving EIC is much more likely to get audited than a wager earner earning $100,000 per year.
If caught, you would have to pay back all of the taxes and penalties and interest back to the original due date of the return. It can be a very painful lesson to learn. |

When (not "if") the IRS catches you you'll have to pay back the EIC payment plus penalties and interest.
Then the both of you will be barred from claiming the EIC for 10 years. Think of how this will affect you if you wind up divorced in a few years and have custody of a couple of kids where the EIC can make the difference between survival and living on the streets.
If it's your REALLY unlucky day the IRS could decide to prosecute you for tax fraud. There has been so much EIC fraud in the past couple of years that it's quite likely that the IRS will make examples of a few folks. That can lead to prison time. Don't be their poster child for Tax Fraud! |

Assuming they get caught, and there's a real good chance they will, they'd have to pay back what they got illegally, with interest and possible penalties, plus could be banned for up to 10 years from collecting EIC even if they were eligible for it. Prosecution is a possibility, but not very likely.
It can take a couple years after you file the return, so keep looking over your shoulder. And by the way, the IRS is very much aware of all the cheating that goes on with EIC, and has been looking at EIC returns much more closely recently. |

You can get arrested --- you'll end up in trouble with the IRS. They'll ask you for proof and you'll be charged with fraud. |

Generally, your marital status on the last day of the year determines your status for the entire year.
If you are unmarried, or if you are legally separated from your spouse under a divorce or separate maintenance decree according to your state law, and you do not qualify for another filing status, your filing status is single.
Generally, to qualify for head of household status, you must be unmarried and you must have paid more than half the cost of maintaining as your home a household that was the main home for a qualifying person for more than half the year. You may also qualify for head of household status if you, though married, file a separate return, your spouse was not a member of your household during the last six months of the tax year, and you provided more than half the cost of maintaining as your home a household that was the main home for more than one half of your tax year of a qualifying person.
If you are married, you and your spouse may file a joint return or separate returns. If your spouse died and you did not remarry in the year that your spouse died, you may still file a joint return for that year. This is the last year for which you may file a joint return with that spouse.
The way I read this, you can't file head of household if you are married and your spouse lived in the house for the last 6 months. If you ARE married and file head of household, your spouse shouldn't have lived with you in the last 6 months, you are taking care of more than 50% of the household, AND, there is ANOTHER dependent (a child or other person that you are more than 50% financially responsible for).
If you are married, and can prove that your spouse hasn't lived with you in the past 6 months (seperated, but not legally...spouse works/lives in another city 6 months out of the year) AND you have another dependent, then you can claim head of household. |

IF they lived together, then they are mistaken or committing fraud--guess what the IRS chooses? When you're married, and lived together most of the year, you file MJF or MFS, and if the latter, you're not eligible for many credits, such as EIC.

You can look up information on line regarding earned income credit. If you file jointly, but only one of you work full-time and your combined income falls under the cutoff for income, I think it is okay, but you really should check the website or speak with a CPA. If you file for EIC under false pretenses, be prepared to get audited. The IRS does not play nice when people try to get out of paying taxes. Be smart and do your homework. |
