What happens if my home is repossesed? Do I still have to pay off debts??
Me and my boyfriend bought a house last March and we have just split up.

He is now living round his mum and dads, and leaving me at home with our 1 year old baby. I can cope, he still comes to see her. We are still paying the mortgage, but I need to get a council house asap as we cannot carry on paying mortgage!

Would it be best to get the house repossesed?? That way the house will go and council will house me and my daughter. Would I have to pay any loans back i had? Works out that I have to pay back about 3000 pounds of debt... I cant afford it tho if im only part time working


please help...im so stressed out!!!!

DO NOT let your home get repossessed!! It will affect every part of you getting credit and even bank accounts in the future. Your £3000 of debt can be sorted. Just pay the minimum or just leave them till the companies threaten you, then you will get letters saying they will threaten court if you do not propose a payment, that's when you 'propose' to pay them back at £10 per month, do it writing and they can't do a thing about it. In the meantime, you can still get the house on the market and be on the housing list, but £3000 isn't worth worrying selling you house over, there are people with triple that amounts of debt living in their own homes.

Best cause of action would be to sell it rather than have it repossesed.

As far as I know the mortgage company can persue you for any money they dont get back from the sale of the house.

You wouldn't be responsible for all the money but maybe any money lost when they resell the home.

If it gets reposessed you won't be able to do much of ANYTHING in terms of credit the next 7 years. You might find it hard to buy a car, rent an apartment, buy a home, get credit cards, etc. It'll cost you in the long run.

If you're really feeling trapped, sell the house at a low price. Even if you get stuck paying some of the difference between what you owe and what you sold it for, it's better than ruining your credit and will save you money.

if the house is repossesed it will probley be sold at auction .if your house was worth say 180 thousand and it sold for 150 thousand you would then have to pay 30 thousand

Do not get repossessed if you can possibly avoid it.
I was 15 years ago, owing £3,500.
4 years later the lenders came after us claiming that we owed £42,500. This is made up from interest, conveyancing fees & any shortfall on the resale.
The first thing to do is to let the lenders know exactly what has happened. As you bought the house with your then boyfriend he is also responsible for any debts on the house, as long as it is in joint names.
You will end up with less debt even if you sell the house at a loss.
Next go to your local CAB. They are very good, helpful and completely non-judgemental. They can advise on any other debts you may have as well.
You will probably find that you are entitled to help with housing as you have a young child. This could take a while though - Speak to your local council and get yourself on the waiting list asap. Sometimes they can be a bit abrupt but be strong - 'Shelter' is an organisation that is very helpful in these situations.

I know it feels really bad at the moment but you will get through it!
You're a mum now - you'll get through anything & don't let the buggers get you down!!

No don't do it.. Really bad idea. You will be blacklisted for loads. If you sell the house and you have made any profit, that should cover your debt??? If not then just pay off a little at a time. Is the debt yours personally or shared with your ex? He should be halvies with it too.

Ask for an appointment with the Money Advice advisor at the local Citizen's Advice Bureau.
Take with you all bills outstanding and list all commitments.
They will contact Agencies to whom you owe money and make arrangements for the best way to pay off sums owed.
It is better for such an Agency to receive regular monthly payments than to receive nothing and to have to pursue claims through the Courts.
You're in a cleft stick position regarding sale of your property - time is against you since it probably takes around 12 weeks to finalise an agreed Sale and you won't get your hands on the residue till everyone else concerned has had their share of the loot. CAB will advise.

I lost my house 15 yrs ago through repossession.I was going through a bad spell with little money coming in.The mortgage
company took me to court and the judge looked at my wages
or income and said i had to pay £374 per month.I tried to keep up the payments but failed.I lost the house eventually
and the bailiffs came and kicked us out.We moved in with
our parents and is was not long before we got letters from the mortgage company asking for the money they lost after they sold our house.We ignored these letters for 10 yrs and sent some back saying not known at this address.They have finally given up sending them.

Your best bet is to try and sell your house if you can,then
repay the mortgage company what you owe,that way you will still have some money left over.I never got that chance but i hope you will.

I'd say get some proper legal advise

either from the money advise line - these helped my sister brilliantly she was in loads of debt loads of loans and stuff they helped her get her debts cut and she pays the min amount now they sorted it all out for her.

or contact your local cab office

both free and at least that way you can be sure of doing the right thing x
