When my wife and I did our taxes we filed jointly. We were just married this past August and based on the requirements of being a dependent we didn't think she could be claimed as a dependent, so when it asked on the form if anyone could claim her we said no. Well we have since found out that her parents interpreted the guidelines differently and actually did claim her as a dependent. Are we going to get in trouble now for saying no one could claim her as a dependent? |

It depends on which of them had the correct interpretation. For a mistake like that, the IRS usually corrects the form and handles the tax figures accordingly, rather than getting someone "in trouble." |

I believe you were correct. Now that she is married, she cannot be claimed as a dependent. Her parents need to file an amended return. |

You won't get into trouble, but her parents will have the dependency claim denied since you and your wife filed a joint return. About all you need to do is send the IRS a copy of your marriage license. That will end the matter immediately.
Since you are married, her parents can NOT claim her any more, regardless of how long she lived in their home or how much support they provided. Even if you married on Dec 31st, her parents could not claim her. |

Marriage trumps dependency.
Believe it or not, you could undo the joint return by amending before 4/15/2008. If undone, then if eligible, her parents could claim her. If you do not amend the return before 4/15, your parents will have to amend and repay any excess refund. |

something similar happened to me when I was young....when i got my first job, i thought i could claim myself when actually since i was in school and only working part time, my mother was still claiming me. All that happened is that when the IRS caught the mistake, they sent us a form to make the corrections and they give you a certain amount of time to make the corrections.
(after our corrections, they owed us more money!) |

Your wife could be claimed as a dependent of her parents if you and your wife would not owe any tax on your separate returns, and you filed only to get a refund of taxes you had withheld.
If this applies to you, amend your return and take your wife's exemption off. Under these circumstances you still will not owe taxes.
If this does not apply, then do nothing. The parents of your wife will need to amend their return and take your wife off as a dependent. |

Not yet, and maybe not even then. Consult an accountant with your in-laws, and determine her legal status. If she can claim herself, then you're good. If she can't, then you need to file an amended return. You have time before the filing deadline and won't get into trouble or even probably have to pay a fine unless you've received cash refunds (again, ask an accountant).
Do it soon, but get it done. And don't worry too much about it after the amended return is filed. |

My interpretation of dependent is that her parents had no right to claim her if you two were married before 12/01/07.
Again the definition can be viewed differently by others as her parents did. |

UH OH! Sounds like a fraud case to me. You had better get a tax specialist to straighten it all out QUICK! You will need to get the parents involved with copies of their tax return also. |

Whoever filed first gets to claim her, when the second filing hits the IRS, it will be kicked back because the social security number has already been filed on. No you don't get in trouble, it just gets kicked back to you for refiling. |
