I am self employeed, and with todays economy it is turning out to be a very bad time in my life financially.
Last year I didn't file taxes because the company I was working for as a independant contractor went out of business, and I was broke then as well.
This year the deadline is coming up quick and without any sales, I am barely able to scrape by. I recently had all of my 3 bank accounts hit up by the IRS to the tune of $7500 for unpaid taxes from 2 years ago (that one I did file but just didn't pay, cause I had no money). Now I know that you say oh $7500? sounds like you had money. But let me assure you that that was a loan from an associate to buy some products, as soon as I had the fiunds in the bank the IRS took it. So I'm screwed on that too now.
What happens if I just don't file? I know I owe them, and I know I probably made about 25-30 thousand this year. Like I said it's been a pretty bad year. |

Here's a brief excerpt:
"If nothing else, at least file your tax return even if you can't pay the full or even a partial amount. The total penalty for failure to file and pay can be 47.5 percent (22.5 percent for late filing, 25 percent for late payment) of the tax owed. Filing would save you the 22.5 percent portion of the penalty." |

Sometime in the next few weeks or months you will find out what will happen if you fail to file again this year. The IRS will be knocking on your mailbox for the taxes you owe from last year. You'll repeat that again next year if you don't file this year.
Last year's debt is now close to 25% higher than it would have been had you at least filed. Add on the penalties and interest for late payment and it'll be closer to 40% more now.
The $7,500 sting you got is just the beginning. More is coming like a freight train in the dark if you don't get off of your duff and file the missing return(s) and set up a payment plan. |

The IRS will still come after you - and get an additional penalty because you didn't file. That is the best I would expect.
File - but once you get your first bill, ask to see if you can work something out with them. I haven't owed that much, but I know they will keep harrassing you until you pay something. anything. You might also talk to a lawyer (or legal aid if you cannot afford one) to see if there is a way to help.

If you owe them; then you are in deep trouble. They calculate interest on the due date of your return (regardless of extensions) until you pay your tax in full. The interest rate on what you owe is variable and may change quarterly This is the "penalty" that you have to pay for being delinquent. Let's say that you file a late return for 2006 (?). You may get a penalty on what was outstanding of about $600 to $700. This penalty must also be paid, with interest, from your missing 2006 return. This is in addition to the taxes that you already owe. A penalty of $600 could finall grow into $1,000 or thereabouts within the space of a year The longer that you leave it; then the deeper you go into debt.
No doubt, you will be hearing from the feds and state telling you that their file indicates that you did not file your return for that year. You could call for advice at 1-800-829-0922 and explain your circumstances. It can't get any worse. So why not give it a try? |

You need to at least file for both last year and this year. Your best bet would be to discuss your situation with an attorney. I think the real quandry is do you intend to pay. If so, you can set up a payment schedule. The important thing is: DON'T KEEP PUTTING THIS OFF. Then your only two alternatives are prison or leaving the country. The IRS takes tax evasion very seriously. That's how the government got Al Capone. |
