What happens if you haven't filed a tax return for 6 years?
I just found out that my brother hasn't filed a tax return for the last 6 years. I guess it started because he thought he would owe a lot the first missed year but would of gotton a refund the other years. He is afraid to start filing because he thinks the Irs will come after him. Does anyone know how this would play out?

I'm not a CPA or a tax lawyer, but this is all common sense.

If he's been working all these years, the IRS will eventually catch up with him.

He should contact the IRS himself, before they contact him. Apologize and try to work something out.

All of us have to pay taxes.

Well i know wesley snipes did this for 5 years and got accuitted but has to do 3 years at least. He's a millionare so I guess if you have the money you can get away with things. I wonder if the IRS chased him like the movie US marshalls? The IRS will get you sooner or later and later would be bad cause the hole would be too black and too deep already. Might as will get more rest than you need in prison

If he files for all the delinquent years, the IRS will calculate any penalties and interest that is due and reduce his refunds for the other years. He needs to file ASAP to stop the interest and penalty accumulation, at a minimum. The worst case is that they catch up with him and he is charged with a crime, which is a felony and mandatory jail time. NOT GOOD!

He would probably do well to go to a CPA. He will owe a lot of fines for the back taxes and most of the Tax CPAs will work directly with the IRS to negotiate for him. I would be sure to seek professional advice.

You should simply file your delinquent returns and wait for the bills to come then deal with them then. I have a client who failed to file for 20 years and that is where we are with him. IRS has a long time policy of not conducting criminal investigations of persons who voluntarily file delinquent returns unless an investigation is already in progress. If an IRS special agent has not come out and read your friend his rights, he is still under the radar. IRS has plenty of other, probably better cases to work.

Your brother should go to his accountant and go with the accountant to the IRS office closest to him. The IRS are not monsters and are very willing to help people. People make mistakes and as long as they are willing to rectify, there is usually no hassle. The longer he leaves it the worse the problem gets and the worse the stress on himself and his family.

He should of filed. He will need to file 06 before 07.If he owes then 1 yr of penelty & interest which is outragious amounts.
If you have a tax program for 06 your in business , if not go to a tax place. He actually just gave the Goverment free money to play with. I will take his refund LOL

Just get the back tax forms, he may come out ahead.
