If you are certain you don't owe taxes and are therefore due a refund, you DON'T have a penalty or fine for not filing and you DON'T have to pay late filing or non-payment fees.
The statute of limitations on refunds is 3 years from the due date of the return; so, the statute just ran for your 2004 return. If you could have received a refund, you just lost it.
You are making an interest free loan to the federal government on any refunds you don't claim. So, get busy and file that return and enjoy your refund!!! |

No, if you don't owe, there's no penalty for filing your federal return late. The only negative thing is if you don't file within three years, you lose your refund.
Some states do penalize you for being late even if you don't owe. |

If you are certain that you do not owe you will have no penalties. The late filing and late pay penalties are based on the amount owed and the number of days the return is late. You forfeit your refund if you do not postmark the return within 3 yrs of the original due date! |

On the federal level, every penalty is a percentage of what you owe. If you don't owe, there is no penalty.
From a practical standpoint, you need to file ASAP. You just don't want to have a track record of late filing. It is not good practice. |

If you do not file how do you expect to get your refund? Go ahead and file Tuesday, May 27th and get your money. There is no penalty since you do not owe money. Get with the program and file your taxes every year before the due date. Wise up. |

There could be a fine for late filing. Any fine would be deducted from your refund. That's how it works. |

Yes if you have a job and taxes got taken out you have to file. Unless you made under 1,000. And yes there is a penalty for filing late |
