According to the IRS:
If you do not receive the missing or corrected form W2 by February 15th from your employer/payer, you may call the IRS at 1-800-829-1040 for assistance. You must provide your name, address (including zip code), phone number, Social Security Number, dates of employment, your employer/payer's name, address (including zip code), and phone number. The IRS will contact the employer/payer for you and request the missing form. IRS will also send you a Form 4852 (PDF), Substitute for Form W-2 or Form 1099-R.
If you do not receive the missing form in sufficient time to file your tax return timely, you may use the Form 4852. If you receive the missing or corrected Form W-2 or Form 1099 after you file your return and a correction is needed, use Form 1040X (PDF), Amended U.S. Individual Income Tax Return. Refer to Topic 308, Amended Returns, for additional information. |

Yes, you can report them to the IRS but it won't make a bit of difference since you're responsible for paying your taxes and filing them on time. I hope you have your pay stubs handy to show what they took out of your salary for taxes and Social Security and all, otherwise you're in for a rough road. If they took the money out and didn't pay it to the proper tax departments, you may have to pay your taxes again!
First, check with S.S. to ascertain that all your quarters for 2007 were paid for. That's a good sign. Call the IRS and they'll walk you through what you need to do. If needs be you can always sue them in small claims court but even there, it can be problematical. You may win and never collect. If it is a large company you'll have a better chance.
I have the feeling this is a small company and they're scamming you. I'd bet they haven't paid in any of your taxes they withheld. You've still got to try but talk to someone higher up and start doing this in writing or you'll have no proof of notifying them of non-receipt. Then apply for an extension on your taxes while you thrash this out with them. |

Definitely report the company to the IRS. It is my understanding that companies have until the last day of January to deliver W-2's. As for your taxes, You have until April 16th to file. Therefore, there may still be a chance that this company will deliver in time. As a final note, you can also use your last paycheck-stub from 2007 to file your taxes. No W-2 necessary. Good luck. |

You can absolutely report them, and you still must report your taxes on time, as usual. Read the IRS info below, but call your former employer and tell the person answering the phone that you need to speak to your former boss regarding a "legal matter." If you still cannot get through to the boss, get in contact with the HR department (if the company has one) as they handle this information.
The following information is all copied directly from the IRS website. (See the links below to read yourself if you prefer).
If you do not receive your Form W-2, contact your employer to inquire if and when the W-2 was mailed. If it was mailed, it may have been returned to your employer because of an incorrect or incomplete address. After contacting your employer, allow a reasonable amount of time for your employer to resend or to issue the W-2.
If you still do not receive your W-2 by February 15th, contact the IRS for assistance at 800-829-1040. When you call, have the following information:
* Employer's name, address, city, and state, including zip code.
* Your name, address, city and state, including zip code, and Social Security number, and
* An estimate of the wages you earned, the federal income tax withheld, and the period you worked for that employer. The estimate should be based on year-to-date information from your final pay stub or leave-and-earnings statement, if possible.
You still must file your tax return on time even if you do not receive your Form W-2. If you do not receive the missing information in time to file, you may use Form 4852, Substitute for Form W-2, Wage and Tax Statement. Attach Form 4852 to the return, estimating income and withholding taxes as accurately as possible. There may be a delay in any refund due while the information is verified.

Call them and get them to mail one to you ASAP. Maybe they sent it to the wrong address or something. If you don't get one, you can file a form called a substitute W-2 and use the numbers on your last pay stub. |

You need to contact your human resources department immediately. It may have got lost in the mail. Legally, it must be post marked BY Jan. 31st!
It will not effect your takes if you get it done my April 15th.
If the hr can not come up with it asap, then I would report them indeed.
You can always contact the irs and file an extension on your taxes and you get until ... August I believe. |

By law a company is to have postmarked and gotten to you your W-2 no later than the last day of January. Some companies, as with the typical behavior of many Americans, will be late in doing this and procrastinate and send out not completely corrected W-2's till later.
That is, some companies get around the requirement by sending out a W-2 by ending January to meet compliance with law, knowing all the while the correct W-2's are mailed shortly thereafter as "amended" W-2's to fulfill their fiscal responsibility.
Yes you can report them -- and you 'should' wish to -- there 'is' protocol that the IRS can initiate, which in turn notifies the company directly, which demands a response from the company post haste. Otherwise, the company puts itself in harm's way with the arm of U.S. Treasury laws.
Call the IRS toll-free number, simply state your reason for the call and be transferred to the section that handles this.
The responsibility rests with the company. The IRS has the transmittals anyway, the W3, which is solely between the company and the IRS, which the company records and has to send to the IRS, which reporting has to correspond with yours. Once a company has sent the W2, it will have fulfilled its legal obligation.
There are instances in which a person did not file but should. In that case the IRS files it but will be completed with the least deductions at the higher tax bracket.
Very large companies with very sophisticated filings and tax matters actually have satellite IRS offices within the company itself to ensure accounting and legalities are managed well.
That you have not received a W2 does not affect your taxes. The tax has already been paid in terms of your payroll. The IRS has record of that already (if it is a legal and ethical company and if not, it will undergo prosecution). Certain dollar amounts have certain thresholds that may or may not require that a person file.
Or if a person does not file but would otherwise receive a refund, the person will not: a form 1040 must be filed to receive any refund.
You are filing your tax form so that any overages by dint of credits and deductions can be credited back to you -- or -- any underages (underwithholding) can be paid to the IRS. |
