What is my filing status?
My spouse and I separated for the final time on July 31, 2007. I obtained a protective order for my children and myself which granted me custody. What is my filing status for the 2007 return. There is no chance of Married Filing Jointly.

The only other option is Married filing separately, because you are ineligible for Head of Household.

Married filing separately. Since you lived together after June 30, you can't file as head of household.

Good luck - and I don't mean just with taxes.

If you were living with your spouse at any time after June 30, 2007, and you do not have a legal separation agreement, then you must file as married filing separately.

If you have a legal separation or did not live with your spouse at any time after June 30, you are considered unmarried and can file as single or head of household if you have a qualifying child that lived with you in your house that you maintained for more than half of the year.

You were still with your husband in July of 2007.
You are still legally married on 12/31/2007.

Therefore you are NOT eligible for head of household, but must use married filing separately.

MFS, but if you are claiming your children make sure he doesn't. Since you were granted custody you should be the only one to claim them.

It is too bad that the date was not June 30, 2007 because you could of file as Head of Household. You have to be separated for the last six months of the year. For 2007, your status would be "Married Filing Separately". That is your only choice for 2007.
