as a married person you only have two choices: MFJ or MFS.
now, regardless of which one you chose if you have any tax liability (meaning that you will not get a refund of all withholdings) then your husband's son can't claim his father as a dependent at all. in this case (and its legal even if you don't support your husband) you should file MFJ so as not not lose the exemption and a bunch of other tax breaks for married people (and to not get punished for filing MFS).

You'd file as married filing separately. You can file a joint return with your husband if you want to, but then he can't be claimed as a dependent. |

If your son is expecting to claim your husband (because he provided more than half of his support and can prove it), then the only remaining choice for you is married filing separately. Keep in mind, if you are receiving social security, some of it will be taxed as income.
If your husband also receives SSA benefits, then he too must file if the amount he gets is more than $3500 since some of his is taxable too. |

You can choose to file married filing separately or married filing jointly. However, there are restrictions if you file married filing jointly.
If your son is going to (I assume properly) claim your spouse, then on your joint return, you do not claim your spouse's exemption. However you will benefit from MFJ even if your spouse cannot claim his own exemption, because you will get a greater standard deduction that way, as well as not lose the many tax benefits that you lose by filing a separate return.
What you cannot do however is file a joint return and claim your spouse's exemption. Well, you could, but then your son could not claim your spouse. |

NOT enough info. Are you self-supporting? Are you living with hubby? For your son to claim your hubby, he must provide MORE than half Dad's support, counting SS, welfare, Medicaid, Medicare, pension, housing, food, medical. If son claims Dad and you are together, you can only file MFS which is NOT good filing status for you, unless you have other dependents.
Being married you have choice of MFJ or MFS, if you are married and together.
Is your son supporting your husband, or your husband supporting your son? |

If you have a husband, then you must file as either "married filing separately" or "married filing jointly". It will usually be advantageous to file jointly, but you can only do so if your husband agrees; if he refuses to file jointly with you, then you must file as married filing separately. |
