Employers have until the end of January to prepare and deliver or mail them to you.
This can mean that, if they were mailed to you, through regular mail, you must wait until February 14th, and if you have not received it yet, you must ask for a replacement. The employer then has 10 days to issue a new one and remail. That means 24 more days. So, you cannot really take any "legal" action until March 10th. And then, surely you realize, that your only recourse is to contact the IRS about this problem. They can possibly look up the amounts, and provide you with the information you need, from the Employer's records.
It is a "privelage" to file your taxes early, not a "right"...... |

First, a lot of people haven't received their tax forms yet-- I haven't.
I'm not going to sue. What are your damages? How has it hurt you to not have had you tax form yet?
The only real case is if they still haven't given it to you until after taxes are due. Then MAYBE you have a claim.
Otherwise just wait... or tell them you are in financial trouble and need it ASAP. Suing won't help. You sue you won't be getting a 2007 tax form that's for sure. |

I know you're not going to do anything about it and you really can't...as everyone else has said he doesn't have to send them until 1/31. After that you can complain to the IRS and they'll come down HARD on him. I think the fine is like $15/return/for first 30 days. So if he mailed it on the 2nd he'd get nailed for $15. That'll teach him! Oh yeah, after you call the IRS you may want to call the unemployment office because you'll be needing unemployment while you search for a new job! |

Are you speaking of a W-2 or 1099? Your boss has until the end of January. If he doesn't get it to you by then, you have no grounds for a lawsuite. Instead, you report the co to the IRS who will impose a penalty on the co for every day that they are late. Or you can be done with the whole mess by just figuring your taxable income from you last paystub in 2006 and be done with it. Takes a bit of shucking and jiving to get the Medicare and SS income correct, but it's doable. |

Your employer has until the end of January to send your W-2's to you. If you haven't recieved them by Feruary 1st, you can go to the payroll office and ask about them. There is no legal action that you can take against them. If you do not recieve a W-2, you can still file based on an estimate of your income and the IRS will contact your employer and fine them for not reporting your income. |

The law says it must be mailed by January 31, so right now, you can do nothing but talk nice to your employer. You can catch more flies with sugar than viniger. On Feburary 1st, then you can get nasty!! |

Start by getting a new job - you obviously don't like working there, don't trust them, or hate your boss. This is not a good fit for you or for your boss. Then, wait until the legal deadline which is January 31. Then, if you have not received in the mail by first few days in February - just ask him first. This is a lot quicker, easier, and nicer than a potentially expensive lawsuit.

The employer has until January 31, 2007. Employers are required to give employees a copy of Form W-2 to be filed with the employee's Federal income tax return (Copy B) and a copy for the employee's records (Copy C). Depending on State laws, the employer may also be required to furnish a copy for state filing.
According to the IRS, an employer that fails to furnish correct payee statements and cannot show reasonable cause, the may employer may be subject to a penalty.
I suggest that if you do not receive your W-2 by 1/31/07, you give the IRS a phone call: 1-800-829-1040. |

You cannot do anything now...he has till the end of January to get it to you. If he does not give them to you by then, you still can't do anything, because you have till the end of April to do your taxes, so technically he probaly has till at least March...but I 'm sure he will get them to you by the end of the month. Mine isn't here yet either and I don't ever get them till the very end of the month.
But I'm no lawyer, so who knows...if he doesn't get it to you by the EOM, you may have something.... Good luck! |

None, you would be expected to estimate the income based on pay stubs, and if it's wrong the IRS will let you know. While they are required to do so, the beef would be between them and the IRS not you. Although I suppose you COULD sue for damages if you had to pay fines due to an insufficient payment. |

It seems that everyone that answers a genuine question gives a useless flip response.
Anyways, I had an ex-employer(temp agency) who I called to meet to pick up my W-2. I showed up but only received one of the two. He then assured me that he would E-mail me the second W-2 directly. A week later, no E-mail, I asked him what was going on and he said he had the W-2 in front of him and when could I come pick it up. I live 30 miles from the office so I asked him to mail it to me. Once again I have not gotten it after another week of empty promises.
Any constructive thoughts? |
