you best thing is to file jointly and be fair and civil about any refunds, otherwise you have to file married separate and that will cost you both the most in taxes maybe even owing tax - no refund - adjust your w-4 for withholding for 2008 in anticipation of filing married separate for 2008 |

The website below can assit you, but based upon the rules for HOH, you do not qualify if he left after July 1.
"Your spouse did not live in your home during the last 6 months of the tax year. Your spouse is considered to live in your home even if he or she is temporarily absent due to special circumstances. See Temporary absences, later. "
Read the publication carefully as well, because if he supported you over 50% of the year, you may not qualify either, and thus filing married joint or married seperate are your ONLY options. |

there is a status that is Married but Filing Separately if you want to keep things separate. If things are amicable between the two of you, you might want to run the numbers as Married & see which way benefits you more. I was in this situation several years ago & it worked out better for me to file Married but Separate. |

I think you would file Married but seperate as for the child if the child has lived with you the full time you get to file for the child tax credit |

depends on your relative incomes, who is supporting the kid, etc. can even file joint if works out the best and you on good enuf terms with him |

Your options are only Married filing Joint or Married filing Separate. Head of Household is only available if you were apart for the last six months of the year. That means you had To be living apart since June 30. |

he is out of the house, you are separted, so you can file married filing separt and if your child lives with you, then you can only claim him and yes you can do head of houshold. |

If you can prove that you gave more than 50 % of the support of the household up to July, Which is the 7th calendar month of the year, you should file as head of household.
You also need to see if you qualify for Earned Income Credit.
There are many different avenues you can take.
Sometimes it's better to itemize deductions, if you make enough.
It all depends on how much you paid in, how much the deductions are stacked up against what you pay in and how much of it your ex plans to abscond with...
That's right, you better protect yourself.
Your estranged husband can tell the IRS that you are still married and he can make off with your return, if you get any.
If you owe, well he's responsible for his share of that too.
Protect yourself, legally.
