Contact the employer, if by Feb 15th you have not received the W2 call the IRS and file a W2 complaint.

The employer is responsible for this, NOT the accountant! The IRS is quite specific on this point.

You should be asking your employer where your W2 is. If you don't receive it by 2/15, call the IRS and file a missing W2 complaint. A single call from the IRS is all it usually takes to get a lazy employer off his butt and get them out.

My next step would be to go over accountant's "head". Talk to your boss. Remind him that the law states that w-2's must be postmarked by January 31st. Give him a date to have your w-2's. This is generous of you, and a if he does not comply to your demand. You will report him to your state treasury / Internal Revenue Service.

An employer is legally required to issue W-2's by the end of January. But that doesn't mean that they will always do so. Any commercial payroll processing house will show on check stubs the year-to-date totals for wages and withholding, and you can use the last one of the year to fill out your taxes. In your case, your checks may not have that information, but you should be able to re-create from the checks the amounts withheld for the various taxes, and you can use these figures (with a note of explanation) if the W-2'x are not forthcoming. The actual forms are not as important now as they were before the days of computers, when they actually served as a cash receipt for withholding taxes paid; they are no longer needed for that purpose, as employer filings provide the necessary data (assuming that they are done properly).

Do you keep your pay stubs, does it carry a total balance for the year on it? With this information you can have your taxes done. You have until April 15, 2007. Wait two more weeks, the accountant will have your stuff by then.
