I am a U.S. citizen, military retiree, living in Germany, receiving military retirement pay and social security payments from the U.S. My wife is a German national (non U.S. citizen, non (U.S:) resident alien) who works and is paid by the German government. For U.S. income tax purposes, may I use the filing status "Married, Filing Separately" and if so, can I claim her as an exemption? She does have a social security number, something she got in the states years ago. Must I report any of her income on my tax return, even though she's paid by the German government? |

I believe your best bet is filing as Married- Filing Separately. You couldn't claim her as a dependent without also reporting her income - no matter where it came from. |

if you file married separately, of course you do not report her income
I don't see how you could claim her as an exemption, she certainly makes more than $3650/yr, you can't claim her as a spouse since you are filing separately--you can't have it both ways |
