It depends.
If they have enough income to be required to pay taxes but evade them by some trick like working under the table, they're called a cheat and a criminal.
If they don't have enough income to have to pay any taxes, there are lots of categories - children and poor are two. |

A criminal. Every US citizen is required to pay taxes. The only tax people could be exempt from is income tax if they are not employed or make less that 15k a year. |
