If I were working for him I would turn him in anonymously. He is still unfair to everyone else there and it is likely to save himself money. He does not pay workman's comp, so if you are injured you are out of luck. He does not pay income taxes so even if you were due a refund you are out of luck. He does not pay Social Security so again you are out of luck and money because you get no credit for the work. Normally I am a live and let live but this guy is shortchanging everyone to save himself a few buck. I would not use my name since you may need the job experience for other employment. |

Keep good records of all pay received from him. Him breaking the law does NOT exempt you from declaring and paying taxes on that money. He should issue you a 1099 by end of January showing how much he paid you, but. . . . This means you will be treated as an independent contractor, as self employed, and have to file a schedule C. You want to keep records and logs and receipts for any expenses you have so that you can reduce the taxable amount of income received, because you will have to pay self employment tax (14%) with your tax return.
You probably should chalk this up to experience and start looking for another job, now that you have this job experience. |

Call your state labor department. He may or may not give you a 1099 so you can pay your taxes. He needs to track all the money he is giving people and then make a paycheck with your tips and all taxes and the cash advances deducted.
If you don't pay SS you won't get SSDI if you are disabled before retirement and your lifetime earnings will be lower. If you die leaving children they wouldn't get survivors benefits. If you get in an auto accident the insurance company will see your lost wages as almost nothing. |

What he is doing is indeed illegal. I would move on and get a better job with a better employer. You can report him if you wish to the IRS or Better Business Bureau. The money you make is still required to be reported. Get away from this bozo fast or you could get caught up in his corruption. |

He's not reporting the cash, so you don't have to either. It's tax free money. There's no record of receipt anywhere. Only report what comes in officially on your year-end 1099. If he doesn't give you one of those, then estimate your income based on TRACEABLE income, not the cash that he's given you under the table.
Anybody who suggests that this is anything less than great has a fundamental lack of understanding about how taxes work. To the IRS it will appear that you have low, or no wages, and that the business has modest profits or even a loss. Cash income frequently goes unreported in small businesses, and is easily distributed to the employees as "under the table" wages.
Don't worry about "not getting a tax refund"... that's ludicrous. At the end of the year you'll submit your 1040EZ as always and you will indicate the amount of pay you've received in checks or direct deposit (leave the cash out). The fact that you've received a "real paycheck" means that he's got the system in place for withholdings - find out what his strategy is and prepare for it when you do your taxes. |
