I think what you're hoping to do is take the child and dept care credit on Form 2441. The first problem I see is this credit is limited to child care which one pays in order to go to work or to look for work. It can be full-time or part-time work. I'm sorry to say that finishing high school, while wise of you and laudable, is not work as defined by the IRS. I don't believe you qualify for the deduction under these facts unless you also had a part-time job (for example) and a portion of the child care was for that work. Even then, only a portion of your child care (attributable to the work time) would be deductible.
If you were otherwise eligible for the credit, and the provider refused to give you her SS#, you must show you used due diligence in trying to collect the required info (name, address and SS# or EIN). Report what info you do have on the Form 2441 and write "see pg 2" in the block(s) for data you don't have. On the bottom of pg 2 of the Form 2441 simply explain that you "repeatedly asked the provider for the information but she declined to provide it."
As a courtesy to her (although this is not required by law or the IRS), I'd tell her what you've done because she is likely to ultimately face penalties if she fails to report the income on her 1040.

Whether or not you take a child care credit on your tax return, this is still income to the person you paid. If you paid her $400 or more, she has a filing requirement. This is not your problem. If this changes her eligibility for public assistance, this is also not your problem.
You will need to file form 2441, put down her name, address and a note about how she wouldn't give you her SSN. |

If you were expecting to claim the money youalso should have asked for a tax ID or SS#. You should also have been expecting to pay MORE, since the amount of tax she would pay would reduce her real income.
That's the trade off for cheap babysitting/daycare; no writeoffs.
If you report her to the IRS you can also expect to have to get a new babysitter. |

You can still file form 2441 and just put refused on the SS number. You will have to file a paper return with the IRS, but if you want to get your refund and use this deduction that is what you will have to do. Takes a little bit of time to get a mailed check but it might be worth it. |

Due Diligence
You can show a serious and earnest effort (due diligence) to get the information by keeping in your records a Form W-10 completed by the care provider. Or you may keep one of the other sources of information listed in the instructions for Form W-10. If the provider does not give you the information, complete the entries you can on line 1. For example, enter the provider's name and address. Enter “See Attached Statement” in the columns for which you do not have the information. Then, attach a statement to your return explaining that the provider did not give you the information you requested.
So you can take your credit but you will need to attach a statement staing that the child care provider refused to give you her ss number. |
