What to do if your company does not deposit your TDS to The Income Tax t Dept
It happened so and Im not sure wheteher I shall get Form 16 either.
I have to file my returns to acquire a loan and I am stuck as to what to do.
Additional Details
My Rs 35000 is stuck in there, like an idiot I trusted them and told them to deduct my TDS and now they tell me it is not deposited.

It is under Income Tax Act 1961 mandatory for all to issue a TDS certificate in case tax has been deducted, it is also mandatory for a employer to Issue form-16A to employee, however from FY 06-07 onwards, it is no more mandatory to attach Form-16A, so u need not worry. Seems Govt. has come to your rescue !!

The Income Tax Department takes care of such companies. If any tax is deducted at source from your company, you have a legal right to ask for TDS certificate for the same. After issue of TDS certificate to you, if the issuing person does not file the same with the Govt. you are not at fault. IT deptt. takes care of such companies.

Hey Cheer Up , if they are giving sleepless night to you than your stigma is over.ASk TDS certificate which is to be issued within 30days of such deduction
A person who deducts TDS but does not deposit is liable to Imprisonment and penalty, just go to competent advisor and take ur stand................U Relax and those people Get Sleaplessness

Obtain form 16 from company.Inform Income Tax Department in your city.There is no reason to worry feel comfortable.

First of fall you go to the website www.tin-nsdl.com register your name and PAN and thereafter check your details whether this TDS has been deducted and informed to the Income Tax Department by way of ereturn by that company, if not so, you write a letter to that company with registered post by saying that you had deducted that tax and not issued any form 16 till today, and in case of failure you will take appropriate legal remedy wait for the time which you given to them in your notice, if they does not reply than make a complaint to the Income Tax Department, The default company is liable to be serious penalties and imprisonment too. See the last date of issuing for the consolidated Form 16 for the Assessment Year 2007-08 was 30th April 2007 so this is the right time to react on your problem.
