First, many employers are now posting the w-2s online to save mail cost. Check with your employer. Second, letter of the law states the employer must only make the w-2 available - they are not required to mail them. Legally, they can make you come to their place of employment to pick them up. This can be entertaining if the employee "left suddenly" - especially if they either stole something or didn't return equipment. Lastly, check www.irs.gov for Topic 154 - Forms W-2 and Form 1099–R (What to Do if Not Received) and use form 4852. Use your end of year or last pay stub to estimate your income and withholding. If your numbers are wildly off, you can submit a 1040x (amended return) later. |

Employers are required to MAIL the w-2 by Jan. 31. If they arrive in February and are not postmarked by the 31st, contact the IRS and state revenue dept. and report them, if you wish. You should be able to do so anonymously. |

From what I understand, every company has to get their employees' W-2s out by that date. If it doesn't get to you postmarked by, well, tomorrow- then you can definietly report them to the IRS. It would show that you tried to get it, and they wouldn't give them out. I don't know what company you work for. If, for example, you work for a construction company, it shows they are not claiming you as an employee (when they're supposed to!) and they can get in some deep legal trouble for that. |

Wait until the first week of Feb. They are legally bound to mail it (postmarked) by Jan 31st - so give it a couple of days into Feb for it to arrive.
If the W2 does not get to you, you can call the employer (if you like them) to remind them, or you have the option to get nasty and call the IRS and complain about them.
Also if you already know your gross, you can file your taxes and indicate in your return that you have not received your W2, the IRS will do the calling for you! |

they have to be postmarked by January 31st not received by January 31.
If you do not have it by February 14 you can call the IRS and they will contact the employer. |

If you don't receive your w-2s, you will have to contact the employer for a duplicate. However, from what I'm reading, you should give them a few more days. They only have to have them mailed out by the 31st, not in your hands by the 31st.

call 1800-829-1040 and state that your employer hasn't provided the w-2s.
you can still file your taxes w/o the w-2s. if you've kept all your paystubs. |

I had the same problem years ago and i took all my check stubs to my accountant and he filled out a form and submitted it along with my other W-2's and it went very smoothe for me |
