What would happen if i filed as head of household on on my taxes even though i have no dependents.?
I am a divorce male that heard that you can file as head of household on your taxes if you itemize I pay for more than 50 percent of the expenses in my home (pay for all of them) is this something that would be considered illegal or is it a loophole of some sort and it would be accepted by the IRS

ok i got this straight form the w-4 form>>>:Generally, you may claim head of household filing status on your tax return only if you are unmaried and pay more than 50% of the costs of keeping up a home for yourself and your dependent(s) or qualifying individuals see line E below.

Seriously dude, you will get kicked out as an audit. You MUST have a qualifying child to qualify for head of household. They changed the rules this year. You have to provide more than 50% of the household maintenance and income for a qualifying CHILD to get head of household. Before your audit comes, I would call the IRS and explain to them. The IRS won't accept it and if you end up refiling late, you'll pay penalties. You are not a qualifying dependant of yourself. Qualifying dependant is what the answer before me stated.

Seriously your return will get rejected and you will probably have to pay a penalty. There is a possibility of one parent taking a deduction for the child and the other parent filing as head of household.

While there some benefit to filing Head of Household, the benefit is not huge.

i never heard of anything like this..first thing they ask is who live with you and for their social security numbers.
If you do get away with it then it will not be long before they audit you.

Prepare for the coming audit! No, you cannot- here is the test you have to pass below. Think about it- why would anyone ever file as single, based on your logic above? The government doesnt always make smart choices, but they arent stupid when it comes to getting their money. Here is the test for someone that is divorced-
Without regard to the person's age, did you keep up a home for your birth child, stepchild, adopted child, eligible foster child, or a descendant of one of these, or your brother, sister, half brother, half sister, stepbrother, stepsister, parent, grandparent, stepparent, son-in-law, daughter-in-law, father-in-law, mother-in-law, brother-in-law, sister-in-law, or your blood related uncle, aunt, nephew, or niece?
You have not found a loophole. The IRS is not stupid, and you will be audited and penalized. You could possibly even be charged with fraud if you piss them off enough.
No, its NOT a loophole. Look at the test I pasted in above for you. I didnt make this up, I copied it from a tax website. Unless you also count yourself as your son, daughter, aunt, or whatever, it wont work. You dont pass the test. Adn refusing to accept the test does not pass muster- you will get audited, you will lose, you will be penalized if you try!

it is illegal unless you are a caregiver for someone who lives with you (other than kids). if audited, it is tax fraud.
