The government doesnt always make smart choices, but they arent stupid when it comes to getting their money. Here is the test for someone that is divorced-
Without regard to the person's age, did you keep up a home for your birth child, stepchild, adopted child, eligible foster child, or a descendant of one of these, or your brother, sister, half brother, half sister, stepbrother, stepsister, parent, grandparent, stepparent, son-in-law, daughter-in-law, father-in-law, mother-in-law, brother-in-law, sister-in-law, or your blood related uncle, aunt, nephew, or niece?
You have not found a loophole. The IRS is not stupid, and you will be audited and penalized. You could possibly even be charged with fraud if you piss them off enough.
No, its NOT a loophole. Look at the test I pasted in above for you. I didnt make this up, I copied it from a tax website. Unless you also count yourself as your son, daughter, aunt, or whatever, it wont work. You dont pass the test. Adn refusing to accept the test does not pass muster- you will get audited, you will lose, you will be penalized if you try! |
