What would happen if i turned my father in for tax fraud?
We both filed taxes last year and got refunds. I didn't really know what I was doing so I let him do both of our taxes. He ended up claiming me on his taxes, therefore allowing him to pay less and for me to get less on my refund($300 less). The thing is that it was illegal for him to claim me since I'm 19 and I was only in school for 2 months when the minimum is 5 months. I was suppose to already get my tax rebate but I'm thinking since he claimed me I get nothing. So basically he has stolen about $900 dollars from me. I did do some snooping and found out he recieved his rebate already and it was $600. I recently round a form on the IRS website that you can turn in to report tax fraud. I was wondering if I do decide to turn it in, would we both end up getting in trouble or just him. If so, what would happen?

Im not sure but i heard a lot of students were going to be disappointed because they were'nt getting anything back anyway, regardless of the dependent thing. But thats besides the point. maybe he made a mistake, maybe he did it on purpose. Maybe he figured he needed more than you right now. Since like he had a thing or two to do with bringing you into this world, clothing you, feeding you, putting a roof over your head, changed dirty diapers, worried about you when you stayed out too late, LOVED YOU!!!!!!!!!!!!!!!! I would consider it in pretty BAD taste to turn him into the IRS. Over a few hundred dollars? There is no amount of money in the world that is worth a child's relationship with there parent. Maybe you should ask him about it. And whatever he says, my advice would be to accept it and move on. Next year, don't let him do your taxes. Sorry if this isn't what you wanted to hear. I understand you are probably really upset with him, but he is your father. you need to make a decision on how much he's worth to you. Because if my daughter EVER did something like that to me, that would be it. I don't think i could even look at her again!

In the future, if someone prepares a return for you, you should check it carefully before signing it. There is a checkbox on that return that needed to be checked for your personal exemption. If he e-filed for you without your permission, that is unfortunate.

The IRS wouldn't treat this as "fraud"...in the sense that they wouldn't be sending him off to jail. The simplest thing to do is to file an amended return (using form 1040X), and take advantage of your personal exemption. This will generate a refund coming to you, after the IRS sends letters to you and him to determine which one of you deserves the exemption. They would then bill him back for some taxes, plus penalty and interest.

The bad news: you wouldn't receive the rebate this year, because the IRS is only considering originally filed returns in situations like this.

The good news: You would get to take advantage of the tax rebate when you file your 2008 return, assuming that you make enough money this year to still qualify.

Now, if you made less than $3400 for the year, and if you live with him, ignore everything I just said. Because he is allowed to claim you as his dependent (and you CAN'T claim yourself).

Seriously, this is NOT of the level of tax fraud, although it is a mistake and he'll have to pay back what he saved by claiming you if you file an amendment and claim yourself, and it's certainly your right to do so. But turn him in for tax fraud? Give me a break! The IRS would just laugh at you.

Not sure how you figure the $900 either. If your refund was just $300 less by being a dependent than it would have been if you weren't, then your rebate would be $300, not the $600 maximum rebate.

I doubt you'd get in trouble since you weren't a party to the fraud. I very much doubt he'd go to jail since it was a fairly small amount, but he'd almost certainly have to pay all the money back along with a significant fine. He'd also be quite angry at you, I'd say.

You would lose your father forever. No, he wouldn't go to jail for that long, but that's how long it would take him to forgive you. Only you can decide if it's worth it. Would he be reasonable if you confront him and ask him to share his saving with you?

If you lived in his house or you are related to him and he paid for more than half of your support he can claim you.

The amount is not necessarily $900 because you are both in different tax brackets and have different deductions.

I don't think you father committed tax fraud, and to report him would do irreparable harm to your relationship.

Your taxes are seperate. What he does cannot affect you. Just claim yourself as normal, and ignore what Dad does. There's no reason to turn him in, but you might want to inform him that you are also claiming yourself, and that he might want to reconsider his tax habits.

If your income was $3400 or more then he wasn't allowed to claim you.

You just need to amend your tax return to claim your exemption and send it in to get the ball rolling. No, because it wasn't on the original return, you won't get the rebate this year, but might when you file for 2008.

Even if you don't amend, the IRS will probably write and ask what high school you were attending since they won't see any report from a college saying you were attending school there....
