This truck was financed for 20,000 now they are trying to get 30,000 and have the irs take from us as well. However, they will not accept any money that has been offered or any payment arrangement that I have offered. I try they will not accept, but now they want to garnish our wages (This will still turn out to be installments) but they will not accept a payment plan! Ironic |

They will just garnish your pay. They should have gotten something for the truck when they auctioned it off or sold it. With the court cost and fees it is still hard to see how it got up to 30K more than the truck sold for.
The IRS won't help them collect but if you let this go to court and they get a judgment you won't be able to get a mortgage or other things until it is paid in full. You might also have trouble landing any decent jobs.
The payment arrangements you offered might have taken too long to collect the money. With interest and the cost of collecting it would take more than 3 years at $1,000 a month so if you offered a tiny amount like $300 a month it would take forever. |

I owned a large repo co in Wa State. You have to check your state laws, But most states treat a repo as a commercial contract. Meaning finance co has a right to demand payment in full after the truck is IN THE BANKS HANDS> wa.state says they have to give you 10 days to come up with ALL owed plus All repo fees Storage ect. If you can"t come up with the cash in the alloted time they are to sell to the highest bidder and sue you for the difference, Sounds what you are in a short scam where they ysell to a friend at a low price and make you come up with the difference. But you might owe a lot more then what the truck what a dealer would pay for it. If by some small chance you owe less then what its worth by law Wa. state they have to pay you the difference, {fat chance} It is a cival matter in most states. I'm sure the are just trying to scare you with the IRS the irs is not a personal collection agency, Check your state laws, I do know That a collector saying the IRS willcollect for them is breaking the law. You go from there |

Has the lender or colleciton agency obtained a court judgment? If so, they can garnish your wages and back accounts. The IRS stuff is bunk. |

There is a guarantee of payment on a garnishment but not on a payment plan I am surprised they are getting a garnish. Usually they forgive the loan and send you a 1099C and you pay taxes on the forgiven amount. |

The IRS doesn't become involved until after the company stops trying to collect from you. When the company writes off the debt, they send the IRS a form 1099-C, at which point you have to deal with possible income. |

30k is the present value of the note. The original amount is not relevant. If you understood compounding interest you would have way more money. The IRS is a refund garnishment and bill collectors use this to get their money. If you legally owe the money then they can get it this way as well as wage garnishment. They are not accepting your money because they likely sold off the loan to someone else. I am sure the company that brought your debt for pennies on the dollar will take your money and typically you can negotiate a lower amount. If they do reduce the amount that you owe the discount is TAXABLE even though you did not get the cash so be prepared for that. |

They can't send the IRS after you. IRS doesn't collect for private companies, so they're lying about this, and poster above is WRONG. IRS refunds can be grabbed--not garnisheed--for back child support and back student loans and HUD loans, but NOT car or truck loans. However, don't try to get a refund anticipation loan product through a tax preparer, because the company might have reciprocal agreements and decline you or take the money.
Is there a nonprofit credit counseling company in your area? Call them, get an appointment, maybe they can negotiate something with the company. They can't garnishee your wages without going to court, so don't skip any court appearances, and get an attorney. |
