When can you file your 2008 income taxes? Also, I'll be using my last check stub instead of the W-2 form. ?
Is that okay?

No, it's NOT okay to use your paycheck stub. You can file with the paycheck stub AFTER 2/15.

The IRS *knows* that people cheat and efile early with the stubs and often hold the refunds until they can verify the amounts. Invariably you get the numbers wrong, have to amend and create more work for the IRS.

Unfortunately, the IRS does allow you to efile as early as 1/16.
(The refund cycle chart has been published and shows the earliest date for transmissions as 1/16.)

No, it's NOT OK to use the final check stub! Check stubs don't always have all of the information necessary to file a legal tax return. Only Form W-2 has the correct information in the proper format to ensure that your return is prepared and filed accurately. I've long lost track of how many amended returns I've had to prepare for folks who used a pay stub and then got a notice from the IRS a year or two later because their return didn't match the IRS records.

The IRS typically starts processing returns during the 2nd week of January. I've heard January 9th bandied about, but the IRS has not posted the official start date on their website yet. If you file a paper return by mail prior to January 1st, it may well be returned to you. And you can't e-file before the official processing start date; the IRS won't accept the return at all.

So, to sum things up: You can file a paper return by mail any time after January 1st. You can e-file once the IRS announces the start of the e-filing season, probably between January 9th and 16th some time. And you MUST use your W-2 to prepare and file your return.

Ms. Angel..
You must wait until you receive your w2 from your employer before you can file.

I prepare taxes and you can only use your last pay check stub to get a refund anticipation loan. When you file your taxes for the IRS as long as you have the correct employers identification number and correct gross income you can file your taxes without a W2. You can file January 16 that's when the IRS starts accepting tax returns. But you can go to a ax professional and get the anticipation loan and get a refund as early as two days.

Strongly urge you to be patient and use your W-2 as required by law. Otherwise bad things might happen.

No, not OK, legally you have to wait for your W-2. The numbers might not match your last check stub, for a variety of reasons.

Tax preparers are not legally allowed to file from check stubs.

You can file in mid January sometime if you have all of your paperwork by then.

travelguruette
You must use your W2. You can only use a last paystub if you cannot get a W2 from the employer. You must wait until after mid February. Your employer has until 1/31 to mail out the W2's

you actually can file at the end of december but i would recommend you file on the 5th of january. yes you can use your last check stub to do so, but be sure to turn in your w2 when they come for verification. you may be entitled to more than what you filled for. I did it last year.

If you work for a small company, they might be willing to do your W2 early. I do if one of my staff asks.

The general rule is usually that you can file as soon as you get your W-2 from your employer. Under no circumstances can you file before January 1.

You can't just use your last check stub. If there's a legitimate reason why your employer can't give you a W-2, you'll need to fill out a Form 4852, Substitute for W-2. This will delay your processing of your return, because the IRS will need to verify the information you report on the form.

As long as the numbers match, no one will know the difference. BUT, if the numbers are different, you could either miss out on your refund or worse, owe money and get penalized with interest when IRS does find you filed incorrectly.
