When claiming a child on your taxes...will the IRS check and see if you support them??
My boyfriend has a child with a married woman. When he was going to do his taxes the woman said that my boyfriend can claim the baby because she wasnt going to give her husband the social security number to claim her. A friend of mine claimed her children even thought she didn't have custody of them. She was in the middle of a terrible custody battle and in the end her ex got the children. Well it back fired and the IRS found out and she had to pay a lot of money back. I am not sure how they found out.

As long as the child is not claimed on two different returns, there shouldn't be any reason for them to check. If she is claimed by both, they will ask for proof of support. If your boyfriend can't provide it, he will be subject to penalties and interest, possibly worse.

if she agree'd to that, i'd get it in writing from her. also, if her hubby does claim the child anyway, you both will be audited.

and if your bf didnt pay for more then 50% of the childs living expenses, then hubby will win.

he can claim and there is nothing wrong with that unless the mother also reports the baby, the thing is that the child can only be reported as dependant once by whoever , it can be reported by a friend or whatever as long as it is only reported ONCE, if the child appears in more than one tax return the will both be audited so just make sure you dont file him twice!!

if he doesn't have the ssn for the child,he can not claim him as a dependent

Since he's the biological parent, he is legally allowed to claim the baby as long as the mother doesn't, if the mother gives him written permission - she can use form 8332 to give this permission to him since he is the child's father. This does not require that he supports the child.

Without this written permission from the mother, he is not allowed to claim her unless she lived with him for over half of the year.
