They must either place them in your hand or in the mail by Jan 31st. (Oddly enough they don't have to be postmarked by Jan 31st, just "placed in the mail.") The IRS allows 15 days for mail and other delays and won't consider any missing W-2 complaints until Feb 15th. |

Dec 31 is the cutoff for your income to count. The law requires that the W2s be mailed no later than Jan 31. The IRS starts accepting returns on Jan 16. |

By the 31st of January. You need a W2 to do your taxes, but you could calculate them based on your Dec 31 paystub. You have to submit the W2 to the IRS unless you file electronically. Do not file unless you know your figures are accurate. |
