They have to be IN THE MAIL by Jan 31st. Since Jan 31st is on a Saturday this year, that is extended to the next business day which is Feb 2nd.

Oddly enough it does NOT have to be postmarked by the deadline. That's a common misconception but the law says nothing about a postmark date. The employer only needs to have placed it in the mail by the deadline. Additionally the IRS won't take missing W-2 complaints until Feb 15th. This effectively gives employers an additional 10 days or so since First Class Mail is virtually always delivered within 5 days anywhere in the country.

Alternatively the employer can hand deliver the W-2s by the deadline or post it on a website for you to retrieve it as long as they also provide a means for you to retrieve it.

Usually they must be postmarked by Jan 31. This year that's a saturday so the postmark date is Feb 2.
