tricityplyr | When filing bankruptcy, are you able to include "RESTITUTION" owed? |
I want to know if it is possible to file bankruptcy on restitution that I owe thru Superior courts. I don't owe the courts the restitution, but I am made to pay thru them. There are 2 cases both from 10 yrs ago!! Original amount of restitution= $20,997.00. TODAY WITH INTEREST= $43,998.68!!! (that's $23,299.72 in INTEREST alone!!!!) The 2nd one originally was= $2,597.00 & TODAY WITH INTEREST= $5,136.74!!!!!?!???!!!!!!! (THAT'S $2,539.74 in INTEREST alone!). Right b4 10 yrs had passed, the court decided to issue a bench-warrant for my arrest for not paying my restitution. After all of this time of not paying on it, NOW they are trying to make me pay, AFTER they tacked on $25,839.46 for interest. I know that when you file bankruptcy that you are not allowed include your Court fines, but you can make them take off the interest that they tack on. Then you only have to pay the original amount due. MY QUESTION IS: Since restitution is not owed to the courts, can I file bunkruptcy on it and not have to ever pay it? |
