It must be given by hand or postmarked by January 31. If you leave employment any time in the middle of the year, you can request your W-2 and they have either 30 or 60 days to give it to you (I forgot which). I always asked just to be a pain in the butt. ;) |

They must be postmarked by January 31, but they can get lost in the mail, or employers can fail to deliver them. If you do not have it in a reasonable amount of time, contact them to find out what the problem is. They should give you a duplicate.
From the IRS FAQ: If you don't receive your Form W-2 (PDF) by February 15, contact the IRS for assistance at (800) 829-1040. Also, you may want to refer to Tax Topic 154, Form W-2 - What To Do if Not Received, to see the specific information the IRS will need in order to prepare Form 4852 (PDF) |

Actually, your employer or previous employer must make your W-2 available to you on or before Jan. 31st of the following year. If you move it is your responsibility to notify them. Legally, if they tell you upon hiring that they DO NOT mail W-2's, they will have it available for you to pick up on or before Jan 31st of following year. If they get really poopy - provide them, via certified letter, a self addressed, stamped envelope to mail your W-2 in...then they are required to mail it. They must send a copy of your w-2 or 1099 to social security no later than the end of Feb...at that time you can report them and complain If they file electronically their deadline is March 31st. |
