Naty | Who's taxes do i go in? |
I got married in December 2007, i didn't work or make any money in 2007... do i file jointly with my husband or do i go in my mom's taxes as a dependent? Also, if i should have filed with my husband, how do i change both of their returns? Is H&R Block expensive? |

H&R block is usually more expensive than a private accountant. As a married individual there are only two options: "married filing joint" and "maried filing separate". If you filed already, you can file an amended return 1040X, for both your parents and yourself with your husband.
Additional benefit to you filing with your husband would have been a bigger stimulus package for $600 vs $300 received as a dependent filing with parents. |

I assume your spouse is required to file, so that he cannot be a dependent of your parents.
You can choose to file with your spouse regardless of any other circumstance, as long as your spouse agrees. Once you have filed a joint return, you cannot, after the filing deadline, amend it so that your spouse can file a separate return and you can be claimed as a dependent on your parents taxes.
If you have not yet filed a return, it may be possible for your parents to claim you. Since it appears that you have already filed, I will omit the rules that would allow you to be claimed by your parents.
You can ask for an estimate from any commercial tax preparer. Since it is the off-season you may find the charges to be less than during the tax season. |

You can choose which way to do it. From your question it sounds like your mom claimed you as a dependent and you and your husband filed separately from each other - that's fine, you don't need to amend the returns. |

If you were eligible to be claimed as a dependent by your mom, you had to make choices.
If you file a joint return with your husband (or amend his MFS return into an MFJ one), then your mother CANNOT claim you unless both you and your husband made less than $3400 each and he only filed to get a refund of his taxes withheld.
If your husband filed an MFS return (if he filed single, he needs to at least amend it to an MFS return), he can leave it that way. When one spouse is young enough to be claimed on a parent's return (especially if the parent is eligible for EIC!), then it's good manners to offer to see which combination of returns results in the least amount of tax owed.
For young husbands, they can really get off on the right side of their inlaws if they let them claim their wife one more time. |

You file jointly with your husband or "married filing separately" status. |

I don't think you need to file unless you got a W-2 form stating your income. It would might help your husband to include you on his taxes and file Married, Filing Jointly and list you as a dependant. I'm not 100% sure tho since I have not been in your situation. |

If you where married prior to 1/1/08 then legally your husband can claim you, and financially that would of helped you, file an amended return for yourselves then let the IRS tell them to change theirs |

Your status as of December 31, 2007 was married and you have to file as married, whether a joint or separate return. |
