Who can claim my son?
My son (6 yr old) stays with me and is disabled draws social security. My husband and I are not divorced but have not lived together since 06. I did not work but I did draw unemplyment in 07. My question is since my son lives with me other then visitations and vacations at dads and draws SSI Can my husband claim him on his taxes? He pays child support and has offered to give some of his return to me. If I claim my son I wont get anythign more back.I didnt know since he drew SSI if it would matter.

Either you or your husband can claim your son. There are no residency requirement for dependency claims if the dependent is your child.

I think if you get the SSI then you need to claim him. Speak to a tax place. They should give you advice for free

As usual, tons of answers by people who can't be bothered to read the IRS publications.

For 2005 and later:

First the IRS determines if this is a qualifying child or not. To be a QC, the child must be under 19 (yours is), live with you more than 6 months out of the year (he does with you, but not the dad) and not provide more than half of his *own* support (he doesn't). Bingo, your child is your QC and you can claim him.

In order for the non-custodial dad to claim him you have to meet additional rules. The biggest one of all is that between you and the dad you provided more than half of his total support.

You include in the support the child's share of housing expenses. You include in the support provided the dad's child support and any money you came up with. The SS disability benefits count as money provided by the state and counts against you.

If you *can* show the two of you provided more than half of the support, then you, as custodial parent, can allow the non-custodial parent to claim the child by signing a form 8832. This gives the non-custodial parent the right to claim the exemption and the child tax credit only. It doesn't include HOH status, EIC or child care credits. (Those still go with the custodial parent.)

If the disability payments are more than his child support payments, the IRS is probably not going to believe that the support test was met.

In most cases, because of the residency test, a child of divorced or separated parents is the qualifying child of the custodial parent. The custodial parent is the parent with whom the child lived for the greater part of the year. The other parent is the noncustodial parent.

Noncustodial parent can claim the child if the custodial parent signs a written declaration (Form 8332) that he or she will not claim the child as a dependent for the year, and the noncustodial parent attaches this written declaration to his or her return.

IRS Publication 17: Your Individual Income Tax; Chapter 3, Exemption for Dependents (Children of divorced or separated parents).

IRS regulations require that the parent who pays more than 1/2 of the child's care gets the deduction.

Regardless how the issue of who claims your son comes out, if you are living separately and maintain the household for your son, you can file as Head of Household even though you are still married.

No one can claim him I believe because your son has his own income and and is not financially depending on neither one of you. Check with the IRS (Federal and State (if you pay state taxes in your state)). If one of you is providing more than 50% of financial support to the child then that person can claim him. I doubt it because in some states (Like California) SSI is quite a lot for a child ...besides the child gets Medicaid and medicare. Probably it's you (the parent) who is using the child's SSI too...(?)...
