Only one person per household that has a qualifying child. That is not married! There is nothing about gender or total amount of income earned in the rules of filing as Head of Household. Example both a man and a female have 2 kids together he makes 50/year and only spends 10k during the year up keeping the house. The female makes 30k per year and spends 15k/year for upkeep and household expenses she would be the one to qualify not the male that made more money!
The IRS just requests only one person per house can file as HoH, they must have a qualifying child, and provide more than 50% of the household expenses. |

Sex has NOTHING to do with this. It has to do with who provides more than half the cost for more than half the year of providing a home for oneself and one's children or dependents, generally closely related (not cousins). Generally it's an unmarried parent. Married individuals living apart may be able to claim HOH. Only one HOH per household. |

Check the www.irs.gov website, but in general, I think this filing status is USUALLY for single parents that have their kids with them. There are other cases with other kinds of dependents. |

You are entitled to the head of household filing status only if all of the following apply:
You were unmarried or met the requirements to be considered unmarried or considered not in a registered domestic partnership as of the last day of the year.
You paid more than half the costs of keeping up your home for the year.
Your home was the main home for you and a qualifying person who lived with you for more than half the year.
The qualifying person met the requirements to be a qualifying child or qualifying relative.

The male can file as head of household if he claims the child that is biologically his as a dependent. Your child is a qualifying person to file as head of household assuming the child lives with you. With the two incomes, I’m assuming that the male is providing over half the cost of maintaining the household – that’s another requirement for h of h.
It’s impossible for TWO people to BOTH provide over half the costs of the same household, so they can’t both file head of household. She probably would get no tax benefit from it anyway if she claims the other two kids.
He can’t claim the female as a dependent (she makes too much money) or her other two kids (they are HER qualifying children, so he can’t claim them).
So he would file as head of household and claim the child who is his child, and she would file as single (if she is) and claim the other 2 kids. The male would itemize if his deductions including the home interest and taxes is over his $7850 standard deduction as head of household. |
