I believe, legally, you are both allowed to claim 50%. If one or other parent claims in whole - documentation of permission from the second parent needs to be attached to the 1st filer's paperwork. Or you should each be able to claim 1 child - call IRS Q & A, they should be able to clarify for you. |

If they live with you EXACTLY the same amount of time, then the parent with the higher income is allowed the exemption by the IRS if they can't agree.. |

No if you go to court they can figure it out for you but usually you take turns....for instance, this year she will claim them and then next year you will.....thats how i do it. |

Most divorced couples claim the children every other year. in some cases the judge will rule who gets to claim what children usually by their age. check you divorce papers to see what it reads because it should be stated in your decree |

Usually, that is decided in your divorce decree. (go back and check) In my situation, my x claims one child every year and I claim the second child (They live with me full-time and hardly ever go with their dad).
If you haven't filed your return and you feel that you are entitled to one exemption, you should do it. (just as long as your divorce decree says so) When the IRS does their auditing and finds the SSN's on both returns, then you'll have to deal with it - or she'll have to deal with it. (check the divorce decree)
If you are not officially divorced yet, then talk with your attorney.
Also, even though the children spend 50/50 with each parent, what is THEIR true mailing address? i.e. What is shown on their school records as their mailing address? |

I live in Fl and there is no such thing as "Joint Custody" here. I have what is called "Physical Custody" with my ex having visitation. My ex was claiming the kids on taxes because he paid child support. If you pay any type of support to her for the kids, then the court would reward you with calamining them on taxes. He stopped paying support...we made other arrangements, and now I claim them on taxes until they are 18. You should talk to your ex and make a decision about who claims the kids and when. Then go to your lawyer and make a change in your divorce decree. If you both agree to it you should not have to go back to court. |

Generally (especially if you have a lawyer worth his/her salt) it is determined in your divorce decree who will claim the children in the divorce. The standard if both parents have joint physical and legal custody then one of two things happen...1) the parents trade off...one year mom claims them both and the next year dad claims them both. 2) the more common and more rational is that one parent claims one child and the other parent claims the other child...
So this year because she claimed them both you don't have any recourse other than to inform her that YOU will be claiming them both next year and from there on out you want a written statment of who will be claiming what when.
I would also inform her that you expect her to give you $300 for one of the children when she recieves the rebate (because it isn't fair because she did not discuss with you who was claiming the children that you should lose out on the benefit when you provide half the care for the children).
Just so you are aware, if the children live with her for more than half the year, she had all rights to claim them because that is the standard the government uses when they determine who has the rights to claim the children when there is no written decree...
If you cannot work this out amicabley then I seriously recomend you go back to your divorce attorney (who obviously dropped the ball on this if there is nothing in your divorce decree) and inform her you want this worked out so you are sharing the benefit from the deductions the children provide. |

I would assume you would alternate each year. You one year and him the next. This worked out well with my brother in law and his ex wife. |
