I agree with all of the above, but you CAN file without receiving a W2. you can complete a substitute W2 if you have your yearly earnings, like from the last pay stub of the year that shows accumulated amounts for the year. You will have to explain your efforts in trying to get the W2 from the employer. however you cannot efile if using a sub. W2.

THere is a contact # at www.irs.gov to file a complaint with.
They will contact them on your behalf; and they ain't going to mess with the IRS

Call the IRS and ask for their assistance. Your ex-emp might be in more trouble than you know. The IRS can help you document your wages so you can get your filing done.

You can file a complaint with the IRS. Normally it only takes one call from the IRS to resolve that issue!

Contact the Department of Labor. That is ilegal and he can get in a lot of trouble. They are the best place to start and they will direct you from there.

Oh yeah, but law they have to be mailed by January 31st.
