Great question! Congress made this difficult. I'll try my best to answer for you because this can mean the difference of tons of money on your refund.
If your girlfriend had no earned income, her earned income credit will be $0 regardless how many children she claims. Therefore, it makes no sense at all that she files a tax return for herself. She doesn't need to and she won't get any refund.
If she truly has no income (or at least earned less than $3,300), and she lived with you all year, and you paid over 1/2 of her expenses, you can claim her as a dependent on your tax return.
If her daughter is NOT your biological child:
If you claim your girlfriend, her child lived with you all year, her child did NOT live with any other relative for over 1/2 the year, and you paid over 1/2 of her child's expenses, then you can claim her child as a dependent too. All you benefit from is the exemption which lowers your income by $3,300. Unfortunately, you will NOT get the EITC, Child Tax Credit, or Child Care Credit. Also, assuming you are married to no one, you must file as Single. Living with someone not related to you does not allow you to file as Head of Household regardless of anything else.
If her daughter IS you biological child:
You can claim her even if she only lived with you for 1/2 the year. You do NOT need to claim her mother nor do you have to pay over 1/2 of her expenses (even though I'd bet you paid 100% of her expenses). In this case, you are eligible to claim the EITC, Child Tax Credit, Child Care Credit, and all other credits that you are normally allowed to claim. You can also file as Head of Household instead of Single. |

If your girlfriend did not have any Earned Income, then she will not be able to get any EITC, if she is your daughter I suggest you claim your daughter and your girlfriend since she is not working. |

If your girlfriend did not work at all, she has no earned income, therefore no entitlement to EIC. As you are unmarried you cannot file jointly, so you simply look at your income. EIC is based on how much you earn, as well as your total income, so it matters a very great deal who claims her.
If your girlfriend had some income last year, the only way to do this is to crunch some numbers. So, I agree with the first answer. Your question suggests that you need a tax pro to do this. Either H & R Block (don't get a loan - if you cannot pay up front, have them take the fee out of your refund for an extra $25) or see a small CPA firm.

You say she's your girlfriend, not wife. Whoever is the child's parent is the one to claim her and file as head of household. Whoever would get more of a refund is irrelevent. |

another thing to think about is there a custody order in place? if there is then it does not matter who would get more because only the person with custody can claim the child and are you her bio dad on her birth cert because if not you cant claim her so be careful |

weather your girlfriend can claim an income tax credit or not depends on your states laws for filing taxes. but the focus here shouldn't be who gets more in a tax return than the other the focus should be your child |
