Who gets to claim the grandbabies if they live with us the grandparents. We are having a hard time this.?
One grandbaby is 13 1/2 months old and has olny lived outside of our home for maybe 2 whole months. The other baby is 9 months old has has lived here for 6 months. The parents totally believe that they should be able to claim their child on income tax when we have raised them and never asked for a penny and they have never offered. The oldest child lives in our home because of CPS. I think our children are being selfish and not thinking about us. Oh might I mention that my daughter and her baby lives with us. My son and his pregnant wife and baby lives with us. These are the kids not thinking of us only of themselves. Got any input?

I'm so sorry to hear about that, you sound like very loving and caring grandparents. I would say though you should be able to claim all the people living with you if they are not paying a penny and the 13 1/2 month old, because if you were more than half there support for the year than legally you can claim them. Your daughter or son would be commiting fraud to claim the children, when they were in your care for that long. I feel so bad, for you I really respect you guys. If things don't work in your favor just know when you help others GOD see's this and blessing will come in other ways. Your great grandparents and the babies are lucky to have someone that will care for them when there parents are not there. I love babies and hate to see them in the wrong hands or with irresponsible parents.

as long as the child has lived there the majority of the year 6 months or longer you can claim the child plus you can collect child support if the parents dont live with u

you claim them AND your children living with you. if your children also claim themselves and the grandkids someone might/might not get an audit. at the audit you prove they lived with you rent free and you'll win. your kids may have to pay a fine for lying on their taxes but it'll be a good leson to learn. if they want to RENT from you and pay you for child care, food, maid service all the things you do for them then it'll be a different story. if you support the pregnant girlfriend (and have her ss#) claim her too.

I agree ! you should claim the babies and the grown kids as dependents. only real parents can get EIC (earned income credit) on kids, grandparents cannot. you can use them as dependents. If you claim the parents as your dependents then they cannot claim themselves or the kids if they file.

You will need to show proof that you are the children`s sole provider if you claim them. This could be an court order giving you custody of the children.

you should its the question the irs ask you who had the kids and spent there money on them for the 6 months or year

Absolutely- God bless you for your kindness, patience and generosity- and I can see your motivation is the well being of your grandchildren. They have no right to claim them since they did not support them and in fact, since they are living with you, I am not sure that they can claim themselves for that matter. Call an attorney- they will usually give you a free consultation and if they cannot sort through this mess, go down to the tax office and speak with a rep there- they surely will be able to clarify who can and cannot be claimed--- I KNOW that you can claim foster children and other children until they are 22-- you didn't mention your children's ages--- also see social services-- you may qualify for WIC and other programs to help support your grandchildren.

or to start paying rent...
also you might see who would get more money if they claimed them or you did that may make it seem your working on a solution...
but if they arent going to school or working and paying rent time to clean house

Check out the tax laws- but I beleive the child has to physically "live with you" (as they did) to claim them.

ok best adise to give you here is talk to a lawyer and a tax man... the child that is with you because of CPS i know you can claim.. however the other ones its a little harder than that.. you have to be able to proove that you provided more than 50% of their care.. and yes you have to proove it. but talk to a tax man and a lawyer they can tell you for sure

my kids and their mom lived in my household all of 2009 and her mom and dad claimed them as dependents on their tax return i did not get nothing back
