In general, it's the custodial parent who gets to claim the child. And no, only one of you can claim him.
A lot of divorced parents make a deal that they each claim the child every other year. If you can get your husband's ex to agree to this, she'll need to sign a form 8332 for him to submit with his tax returns.
Child support is never deductible. The everyday costs of raising a kid are never a tax deduction, not to any parent. |

The parent with whom the child resides the greater period of time is considered the custodial parent. The custodial parent has priority to claim the child, but may waive the exemption to the noncustodial parent.
Child support is not relevant to the tax exemption. Child support is not deductible.
If child support is received from the father, that is an indication that the child actually lives with the mother. If this is not the case, the father can request a change in support payments. |

Only one of you can claim him, and that's the parent he spends more nights with during the year - you might have to count the days to determine that if you switch off weeks. Paying child support doesn't enter into the decision of who can claim him. |

No claim for child support is allowed on tax returns.
Only one person is allowed to claim an exemption for any one child.
Only one person is allowed to claim any one child for other tax purposes, such as the earned income credit.
These are not always the same person.
However, in the circumstances that you describe, she is probably both the person who can claim the exemption and the person who can claim him for the various credits, etc. |

From your quick note: His mother gets the deduction - you get nothing.
What both parents need to work out is: "Who is paying more than 50% of the child's annual (overall) support?" AND... If the parent who has legal custody (is not,) will she/he be willing to give up the exemption to the non-custodial parent [ Form 8332, Release of Claim to Exemption...] Maybe the two parents could work out to who's Tax Return would be the greater advantage.

A: Nothing can be deducted for the child support payments. Child support payments are neither deductible by the payer nor taxable income to the payee. You may be able to claim the child as a dependent. The parent who the child lived with for the greater part of the year is the custodial parent. Generally the custodial parent is allowed to claim the exemption for the child if the other exemption tests are met. However, the noncustodial parent may be allowed to claim the exemption for the child if the custodial parent signs a Form 8332, Release of Claim to Exemption for Child of Divorced of Separated Parents, or a substantially similar statement.
